Response to Office Action

To the Commissioner for Trademarks:

Application serial no. 88026965 INTEGRATED TECHNOLOGY DELIVERY(Standard Characters, see http://uspto.report/TM/88026965/mark.png) has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

The initial term, INTEGRATED, has four meanings, according to Webster's Dictionary, 2nd Edition, copyright 1975. The four definitions are (1)to make whole or complete by adding or bringing together parts; (2) to put or bring (parts) into a whole, to unify;  (3)to give or indicate the whole, sum, or total of..(4)in mathematics (a) to calculate the integral, or integrals, of (a) function, equation, etc...(b)to perform the process of integration.

The definitions emphasize the addition of components, or component systems, to form a unified or unitary whole. Applicant's mark is applied to systems or components that function individually or in concert, but are not joined or united physically. Thus the term INTEGRATED may be deemed to be suggestive, but not descriptive of applicant's program. Furthermore, a composite mark including INTEGRATED should also be considered to be suggestive, but not descriptive.

An Amendment to Allege Use, supporting applicant's assertion of descriptiveness, was filed on April 22, 2019.

CLASSIFICATION AND LISTING OF GOODS/SERVICES
Applicant hereby deletes the following class of goods/services from the application.
Class 037 for project management and engineering services for integrating converged voice, data, Wi-Fi, distributed antenna systems, audio-vision solutions, and electronic security systems on a cabling and switching infrastructure

Applicant hereby adds the following class of goods/services to the application:
New: Class 042 (Original Class: 037 ) for computer project management and engineering services for integrating converged voice, data, Wi-Fi, distributed antenna systems, audio-vision solutions, and electronic security systems on a cabling and switching infrastructure
Filing Basis: Section 1(b), Intent to Use: For a trademark or service mark application: As of the application filing date, the applicant had a bona fide intention, and was entitled, to use the mark in commerce on or in connection with the identified goods/services in the application. For a collective trademark, collective service mark, or collective membership mark application: As of the application filing date, the applicant had a bona fide intention, and was entitled, to exercise legitimate control over the use of the mark in commerce by members on or in connection with the identified goods/services/collective membership organization. For a certification mark application: As of the application filing date, the applicant had a bona fide intention, and was entitled, to exercise legitimate control over the use of the mark in commerce by authorized users in connection with the identified goods/services, and the applicant will not engage in the production or marketing of the goods/services to which the mark is applied, except to advertise or promote recognition of the certification program or of the goods/services that meet the certification standards of the applicant.
