I have reviewed your client’s trademark applications serial nos. 88017844 and found no conflicting marks. However, there is one remaining issue:
Identification Requirement: The wording “Bone implants comprising demineralized bone matrix for use in surgical procedures” must be further clarified so as to distinguish it from Class 010 bone implants. If accurate, may I suggest the following:
Class 005: Human allograft bone and tissue; Human allograft tissue in the nature of demineralized bone matrix used for use in surgical procedures; Surgical implants for the bone comprising living tissue in the nature of demineralized bone matrix for use in surgical procedures; Biological demineralized bone matrix tissue intended for subsequent implantation
If your client agrees, I note the change via Examiner’s Amendment. Please let me know how you wish to proceed.
