This Examiner’s Amendment is in response to applicant’s Response to Suspension Inquiry dated October 10, 2019. In light of applicant’s response and the Examiner’s Amendment below, the following requirements have been satisfied or obviated:

 

(1)   Foreign Registration Requirement

 

Application has been amended as shown below. As agreed to by attorney of record, Christopher Hussin, on October 30, 2019, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections. TMEP §707. Otherwise, no response is required. Id. In addition, applicant is advised that amendments to the goods are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods s are not permitted. 37 C.F.R. §2.71(a).

 

IDENTIFICATION OF GOODS

 

The identification of goods is amended to read as follows: 

 

Class 005: Herbal supplements for general health and well-being; Nutritional supplements for general health and well-being; Dietary supplements for general health and well-being; Botanical nutritional and dietary supplements for general health and well-being; Vitamins; Mineral supplements; Nutraceutical-based medicated cosmetics

FILING BASIS

 

The applicant has elected to proceed with the 44(e) filing basis only.

 

The Section 1(b) filing basis is deleted.
