TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issues below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
SECTIONS 1, 2, 3, AND 45 REFUSAL – FAILURE TO FUNCTION
Terms and expressions that merely convey an informational message are not registrable. In re Eagle Crest, Inc., 96 USPQ2d 1227, 1229 (TTAB 2010). Determining whether the term or expression functions as a trademark or service mark depends on how it would be perceived by the relevant public. In re Eagle Crest, Inc., 96 USPQ2d at 1229; In re Aerospace Optics, Inc., 78 USPQ2d 1861, 1862 (TTAB 2006); TMEP §1202.04. “The more commonly a [term or expression] is used, the less likely that the public will use it to identify only one source and the less likely that it will be recognized by purchasers as a trademark [or service mark].” In re Hulting, 107 USPQ2d 1175, 1177 (TTAB 2013) (quoting In re Eagle Crest, Inc., 96 USPQ2d at 1229); TMEP §1202.04(b).
The attached evidence from www.acronymfinder.com, www.lifewire.com, www.netlingo.com, www.npr.org, www.bonappetit.com, and www.geekwire.com shows that this term or expression is commonly used as a shorthand of the phrase "Talk To You Later" and conveys a common abbreviation typically used online. Because consumers are accustomed to seeing this term or expression commonly used in everyday speech by many different sources, they would not perceive it as a mark identifying the source of applicant’s goods and services but rather as only conveying an informational message.
An applicant may not overcome this refusal by amending the application to seek registration on the Supplemental Register or asserting a claim of acquired distinctiveness under Section 2(f). TMEP §1202.04(d); see In re Eagle Crest, Inc., 96 USPQ2d at 1229. Nor will submitting a substitute specimen overcome this refusal. See TMEP §1202.04(d).
Although applicant’s mark has been refused registration, applicant may respond to the refusal by submitting evidence and arguments in support of registration. However, if applicant responds to the refusal, applicant must also respond to the requirements set forth below.
IDENTIFICATION OF GOODS AND SERVICES – Particular Goods and Services in Classes 9 and 38 Only

Additionally, the wording "Downloadable mobile applications for pproviding on-line chat rooms for transmission of messages among users in the field of general interest and for users to share information, photos and videos and autdio content to get feedback from peers and to form virtual communities and to engage in social networking" is indefinite and must be clarified to further specify the function of the software. See below for suggestions.
Class 38
The wording "scoial", "mong", "henadheld", and "revceive" in the identification of services in Class 38 appears to be misspelled and is thus indefinite; the spelling must be corrected or the wording further clarified. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01(a). Applicant may substitute the following wording for the incorrect spelling, if accurate: "social," "among," "handheld," and "receive."
Additionally, the wording "Providing on-line chat rooms for transmission of messages among computer users concerning topics of general interest and photos, videos and audio content to get feedback from peers, to form virtual communities and to engage in scoial networking" is indefinite and must be clarified to specify the nature of the services. See below for suggestions.
Moreover, the wording "Telecommunications gateway services, namely, providing telecommunication facilities for real-time interactions between and mong users of computers, mobile and henadheld devices, and wired and wireless communication devices, enabling individuals to send and revceive voice feeds and chats" is indefinite and must be clarified to specify the nature of the services. See below for suggestions.
Applicant may adopt the following identification, if accurate:

with other computer users concerning topics of general interest

For this application to proceed further, applicant must explicitly address each refusal and/or requirement raised in this Office action. If the action includes a refusal, applicant may provide arguments and/or evidence as to why the refusal should be withdrawn and the mark should register. Applicant may also have other options specified in this Office action for responding to a refusal and should consider those options carefully. To respond to requirements and certain refusal response options, applicant should set forth in writing the required changes or statements. If applicant does not respond to this Office action within six months of the issue/mailing date, or responds by expressly abandoning the application, the application process will end and the trademark will fail to register. See 15 U.S.C. §1062(b); 37 C.F.R. §§2.65(a), 2.68(a); TMEP §§718.01, 718.02. Additionally, the USPTO will not refund the application filing fee, which is a required processing fee. See 37 C.F.R. §§2.6(a)(1)(i)-(iv), 2.209(a); TMEP §405.04.
When an application has abandoned for failure to respond to an Office action, an applicant may timely file a petition to revive the application, which, if granted, would allow the application to return to active status. See 37 C.F.R. §2.66; TMEP §1714. The petition must be filed within two months of the date of issuance of the notice of abandonment and may be filed online via the Trademark Electronic Application System (TEAS) with a $100 fee. See 37 C.F.R. §§2.6(a)(15)(ii), 2.66(a)(1), (b)(1).
If applicant has questions regarding this Office action, please telephone or e-mail the assigned trademark examining attorney. All relevant e-mail communications will be placed in the official application record; however, an e-mail communication will not be accepted as a response to this Office action and will not extend the deadline for filing a proper response.
