Dear Mr. Lampert:
I am the Examining Attorney assigned to the above-referenced applications. There is one issue that requires resolution.
1. Varietal Name Inquiry - To permit proper examination of the applied-for mark, applicant must indicate the following:
(a) Whether SUNGLOW or UPTOWN has ever been used or will be used as a varietal or cultivar name; and
(b) Whether SUNGLOW or UPTOWN has ever been used or will be used in connection with a plant patent, utility patent, or certificate for plant-variety protection.
Kindly contact me on or before 10/11/2018 to resolve these issues. I look forward to your reply.
