On December 3, 2019, the applicant filed a petition to the Director to request entry of a disclaimer for the wording BLUE DIAMOND in the mark after issuance of the notice of allowance and before filing a statement of use.

 

The assigned Petitions paralegal reviewed the petition to the Director and issued a notice advising that the petition is denied under 37 C.F.R. §2.77(b) because the requested amendment requires review by the examining attorney.

 

If applicant wishes to request reconsideration, another petition to the Director can be submitted asserting an extraordinary circumstance that would warrant waiving 37 C.F.R. §2.77(b).
