EXPLANATION OF FILING
The Owner (Registrant) hereby requests to amend the registration pursuant to ?7(d) of the Trademark Act, 15 U.S.C. ?1057(d). Specifically, Owner (Registrant) submits that the registration mistakenly identifies as the Owner (Registrant) as K-Motion Interactive, LLC, which did not exist as a legal entity on the application filing date or at any time thereafter. Accordingly, Owner (Registrant) hereby respectfully requests that the Owner (Registrant) information be amended from: K-Motion Interactive, LLC A100 16419 N. 91st Street Scottsdale, Arizona United States 85260 TO K-Motion Interactive, Inc. A100 16419 N. 91st Street Scottsdale, Arizona United States 85260 Also, the Owner (Registrant) respectfully requests that the Legal Entity Information be amended from: Type: limited liability company TO: Type: corporation Owner (Registrant) acknowledges owner/holder error. Owner submits that the above errors were typographical errors and occurred in good faith. Owner recently became aware of the above typographical errors in the registration due to an Office Action issued for U.S. Application Serial No. 88805004. When a non-existent entity is listed as the Applicant, the application may be amended to correct the Applicant?s name. See TMEP 1201.02(c), example number 7. For the foregoing reasons, Applicant hereby respectfully requests that the Owner (Registrant) Information and Legal Entity Information be amended to properly reflect the Owner (Registrant) details. Owner (Registrant) also respectfully requests issuance of a new registration certificate in the correct name and entity of the owner, K-Motion Interactive, Inc. Owner (Registrant) submits herewith the required fee (37 C.F.R. ??2.6(a)(8) and 3.41).
