This communication is in reference to the application filed on behalf of your client, Dana Alexander, Inc. to register the trademark TERRA (Application No. 88000212). The application was filed with the USPTO on June 14, 2018. I also left a voice message for you this morning.
This mark has been reviewed and is close to being ready for publication. However, there is a minor issue with the identification of goods that I would like to try and resolve via an Examiner’s Amendment so that we can finalize review of the application.
Specifically, the goods in Class 29 are misclassified; according to our ID manual, “crackers” of any kind are in Class 30. Therefore, I propose amending the identification of goods as follows:
AMENDMENT OF IDENTIFICATION OF GOODS
The identification of goods would be amended to read as follows:
International Class 30: crackers; grain-based snack foods, vegetable based crackers, nut or seed based crackers, dried fruit-based crackers
