THIS PARTIAL REFUSAL APPLIES TO CLASS 36 ONLY
Applicant has applied to register its mark in connection with the following services in Class 36:
Class 36: Cryptocurrency exchange services; Currency exchange services; Currency trading; Currency transfer services; Cryptocurrency trading services; Financial information; Financial information and advisory services; Financial consultation in the field of cryptocurrency; Financial information provided by electronic means in the field of virtual currency exchange, virtual currency trading, virtual currency transfer, virtual currency conversion, currency and financial information, currency trading information, currencies, and virutal currencies; Financial services, namely, providing electronic transfer of a virtual currency for use by members of an on-line community via a global computer network; Providing information in the field of finance; Providing financial information; Providing financial information services to individuals, groups, companies and organizations in the fields of virtual currency exchange, virtual currency trading, virtual currency transfer, virtual currency conversion, finacial analysis, financial consulting, currency and financial information, currency trading information, currencies, and virtual currencies; Provision of financial information
“Whether consumers could guess what the product [or service] is from consideration of the mark alone is not the test.” In re Am. Greetings Corp., 226 USPQ 365, 366 (TTAB 1985).
The wording RESERVE means “a stock of funds kept available by a bank, insurance company, etc. to meet ordinary or probably demand.” See attached evidence from the Oxford English Dictionary.
Please also see the attached evidence from Independent Reserve, Bright Ideas Reserve, and Bitcoin Cryptocurrency, showing cryptocurrency funds and financial advice markets use the wording “RESERVE” to describe a feature of the services.
As applied to applicant’s services of cryptocurrency exchanges and financial services, the wording RESERVE describes a feature or function of the applicant’s services. Specifically, applicant’s services feature a stock of cryptocurrency funds.
Accordingly, the proposed mark is merely descriptive, and registration is refused on the Principal Register under Section 2(e)(1).
Although applicant’s mark has been refused registration, applicant may respond to the refusal by submitting evidence and arguments in support of registration.
TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.
