PARTIAL SECTION 2(e)(1) REFUSAL - MERELY DESCRIPTIVE

THIS PARTIAL REFUSAL APPLIES TO CLASS 35 ONLY

 

Registration is refused because the applied-for mark merely describes the features of applicant’s services.  Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1); see TMEP §§1209.01(b), 1209.03 et seq.

 

A mark is merely descriptive if it describes an ingredient, quality, characteristic, function, feature, purpose, or use of an applicant’s services.  TMEP §1209.01(b); see, e.g., In re TriVita, Inc., 783 F.3d 872, 874, 114 USPQ2d 1574, 1575 (Fed. Cir. 2015) (quoting In re Oppedahl & Larson LLP, 373 F.3d 1171, 1173, 71 USPQ2d 1370, 1371 (Fed. Cir. 2004)); In re Steelbuilding.com, 415 F.3d 1293, 1297, 75 USPQ2d 1420, 1421 (Fed. Cir. 2005) (citing Estate of P.D. Beckwith, Inc. v. Comm’r of Patents, 252 U.S. 538, 543 (1920)). 

 

The determination of whether a mark is merely descriptive is made in relation to an applicant’s services, not in the abstract.  DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1254, 103 USPQ2d 1753, 1757 (Fed. Cir. 2012); In re The Chamber of Commerce of the U.S., 675 F.3d 1297, 1300, 102 USPQ2d 1217, 1219 (Fed. Cir. 2012); TMEP §1209.01(b); see, e.g., In re Polo Int’l Inc., 51 USPQ2d 1061, 1062-63 (TTAB 1999) (finding DOC in DOC-CONTROL would refer to the “documents” managed by applicant’s software rather than the term “doctor” shown in a dictionary definition); In re Digital Research Inc., 4 USPQ2d 1242, 1243-44 (TTAB 1987) (finding CONCURRENT PC-DOS and CONCURRENT DOS merely descriptive of “computer programs recorded on disk” where the relevant trade used the denomination “concurrent” as a descriptor of a particular type of operating system). 

 

“Whether consumers could guess what the product [or service] is from consideration of the mark alone is not the test.”  In re Am. Greetings Corp., 226 USPQ 365, 366 (TTAB 1985).

 

Applicant’s applied-for mark is DEALMED for “surgical and medical apparatus, instruments, supplies and consumables” in International Class 10 and “retail services in connection with surgical and medical apparatus, instruments, supplies and consumables; wholesale ordering services in the field of surgical and medical apparatus, instruments, supplies and consumables” in International Class 35.

 

Generally, if the individual components of a mark retain their descriptive meaning in relation to the services, the combination results in a composite mark that is itself descriptive and not registrable.  In re Fat Boys Water Sports LLC, 118 USPQ2d 1511, 1516 (TTAB 2016) (citing In re Tower Tech, Inc., 64 USPQ2d 1314, 1317-18 (TTAB (2002)); TMEP §1209.03(d); see, e.g., Apollo Med. Extrusion Techs., Inc. v. Med. Extrusion Techs., Inc., 123 USPQ2d 1844, 1851 (TTAB 2017) (holding MEDICAL EXTRUSION TECHNOLOGIES merely descriptive of medical extrusion goods produced by employing medical extrusion technologies); In re Cannon Safe, Inc., 116 USPQ2d 1348, 1351 (TTAB 2015) (holding SMART SERIES merely descriptive of metal gun safes); In re King Koil Licensing Co., 79 USPQ2d 1048, 1052 (TTAB 2006) (holding THE BREATHABLE MATTRESS merely descriptive of beds, mattresses, box springs, and pillows). 

 

Only where the combination of descriptive terms creates a unitary mark with a unique, incongruous, or otherwise nondescriptive meaning in relation to the services is the combined mark registrable.  See In re Colonial Stores, Inc., 394 F.2d 549, 551, 157 USPQ 382, 384 (C.C.P.A. 1968); In re Positec Grp. Ltd., 108 USPQ2d 1161, 1162-63 (TTAB 2013).

The attached evidence shows that the wording DEAL means “a bargain”. See the attached dictionary definition from CollinsDictionary.com. Further, the wording MED is an abbreviation for “medical” or “medicine” which is defined as “relating to illness and injuries and to their treatment or prevention”. See the attached dictionary definitions from CollinsDictionary.com.

 

In addition, applicant’s identification of goods and services specifies that applicant is providing “surgical and medical apparatus, instruments, supplies and consumables” and “retail services in connection with surgical and medical apparatus, instruments, supplies and consumables”. Further, the attached evidence from applicant’s website shows that applicant is providing its bargained medical supplies and apparatus via its retail store services. Specifically, that applicant is “committed to filling the gap as an honest supplier with true pricing transparency” and they offer programs and services “all designed to save customers money and improve efficiency and consistency with the medical product supply chain”. See the attached screen-shot from applicant’s website.

 

In this case, both the individual components and the composite result are descriptive of applicant’s services and do not create a unique, incongruous, or nondescriptive meaning in relation to the services.  Specifically, the individual components when combined merely describe the features of applicant’s services, namely, that applicant is providing retail services and whole sale ordering services featuring bargain or discount for medical treatment or prevention services.

 

Therefore, the wording DEALMED is merely descriptive of applicant’s services and registration on the Principal Register must be refused under Trademark Act Section 2(e)(1).

 

SUPPLEMENTAL REGISTER ADVISORY

 

The applied-for mark has been refused registration on the Principal Register.  Applicant may respond to the refusal by submitting evidence and arguments in support of registration and/or by amending the application to seek registration on the Supplemental Register.  See 15 U.S.C. §1091; 37 C.F.R. §§2.47, 2.75(a); TMEP §§801.02(b), 816.  Amending to the Supplemental Register does not preclude applicant from submitting evidence and arguments against the refusal(s).  TMEP §816.04.

 

Although registration on the Supplemental Register does not afford all the benefits of registration on the Principal Register, it does provide the following advantages to the registrant:

 

(1)       Use of the registration symbol ® with the registered mark in connection with the designated goods and/or services, which provides public notice of the registration and potentially deters third parties from using confusingly similar marks.

 

(2)       Inclusion of the registered mark in the USPTO’s database of registered and pending marks, which will (a) make it easier for third parties to find it in trademark search reports, (b) provide public notice of the registration, and thus (c) potentially deter third parties from using confusingly similar marks.

 

(3)       Use of the registration by a USPTO trademark examining attorney as a bar to registering confusingly similar marks in applications filed by third parties.

 

(4)       Use of the registration as a basis to bring suit for trademark infringement in federal court, which, although more costly than state court, means judges with more trademark experience, often faster adjudications, and the opportunity to seek an injunction, actual damages, and attorneys’ fees and costs.

 

(5)       Use of the registration as a filing basis for a trademark application for registration in certain foreign countries, in accordance with international treaties.

REQUEST TO DIVIDE ADVISORY

 

In response to a refusal or requirement that pertains only to certain classes, goods, and/or services, applicant may divide the application into two or more separate applications so that any acceptable classes, goods, and/or services may proceed toward registration.  See 37 C.F.R. §2.87; TMEP §§1110 et seq. (regarding requests to divide).  Any outstanding deadline in effect at the time the application is divided will generally apply to each new divided out application.  See 37 C.F.R. §2.87(e); TMEP §1110.05 (see list of exceptions).

 

Applicant may file a request to divide online via the Trademark Electronic Application System (TEAS) for a fee of $100 for each new application created.  See 37 C.F.R. §§2.6(a)(19)(ii), 2.87(b); TMEP §1110.04.  The request to divide must specify the classes or goods and/or services that are to be divided out of the application.  If dividing out some, but not all, of the goods or services within a class, an additional application filing fee will be required for each new separate application created by the division.  37 C.F.R. §§2.6(a)(1)(i)-(iii), 2.87(b); TMEP §1110.02. 

 

If applicant responds to the refusal, applicant must also respond to the requirement set forth below.

 

IDENTIFICATION OF GOODS AND SERVICES

 

The wording “surgical and medical apparatus, instruments, supplies, and consumables” in the identification of goods is indefinite and must be clarified because it fails to state the nature of the goods.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. 

 

The activities identified as “retail services” in International Class 35 are indefinite and must be clarified because retail services could include a wide array of retail support services – from accounting to advertising and marketing services.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.11. 

 

If applicant’s retail services involve retail stores or outlets (online or brick-and-mortar), or distributorships, applicant should amend the identification to specify (1) the nature of the retail activity provided (e.g., retail stores, retail distributorships, online retail outlets), and (2) the field or type of goods offered through those retail services, e.g., “retail online ordering services featuring surgical and medical apparatus, instruments, supplies and consumables.”  See TMEP §§1301.01(a)(ii), 1402.11. 

 

 

Applicant may substitute the following wording, if accurate, with additions in bold:

 

International Class 10:           Surgical and medical apparatus, instruments, supplies, and consumables, namely, {specify items, e.g., scalpels, blades, staplers}

 

International Class 35:           Retail store services featuring surgical and medical apparatus, instruments, supplies and consumables; Wholesale ordering services in the field of surgical and medical apparatus, instruments, supplies and consumables

 

Applicant may amend the identification to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted goods and/or services may not later be reinserted.  See TMEP §1402.07(e).

DECLARATION AMENDMENT

 

The application does not include the required statement that the mark is in use in commerce.  Therefore, applicant must submit the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20:

 

The mark is in use in commerce and was in use in commerce as of the application filing date.

CONCLUSION

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
