The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
INFORMALITIES
· The wording “Primary brand consolidating” does not help describe the applicant’s goods but rather explains the purpose of the applicant’s mark and therefore should be deleted.
· The wording “blended mortar” is indefinite and must be clarified, e.g. “blended mortar for building” and “blended asbestos mortar.”
Applicant may adopt the following wording, if accurate:
Masonry products, namely, concrete blocks, clay bricks, masonry wall systems comprised of bricks, stones, and mortar for building, stacked stone, architectural stone veneers, blended asbestos mortar, grout, stucco and cement mixes and moisture management systems comprised of non-metal troughs and collection boxes. International Class 19.
