SPECIMEN REFUSAL
THIS REFUSAL APPLIES TO CLASSES 35 AND 38 ONLY
CLASS 35
Registration is refused because the specimen in International Class 35 does not show a direct association between the applied-for mark and the identified services; thus the specimen fails to show the applied-for mark in use in commerce. Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a), 1301.04(f)(ii), (g)(i).
Specimens consisting of advertising or promotional materials must show a direct association between the mark and the services for which registration is sought. In re WAY Media, Inc., 118 USPQ2d 1697, 1698 (TTAB 2016) (quoting In re Universal Oil Prods. Co., 476 F.2d 653, 655, 177 USPQ 456, 457 (C.C.P.A. 1973)); TMEP §1301.04(f)(ii). To show this direct association, the specimen must contain an explicit reference to the services, in addition to the mark being used on the specimen to identify the service and its source. In re WAY Media, Inc., 118 USPQ2d at 1698 (quoting In re Osmotica Holdings, Corp., 95 USPQ2d 1666, 1668 (TTAB 2010)); TMEP §1301.04(f)(ii). While the exact nature of the services does not need to be specified in the specimen, there must be something which creates in the mind of the purchaser an association between the mark and the service. In re Adair, 45 USPQ2d 1211, 1215 (TTAB 1997) (quoting In re Johnson Controls Inc., 33 USPQ2d 1318, 1320 (TTAB 1994)).
In the present case, although the specimens show webpages for online retail store services, the mark used in connection with the online retail store services appears to be “NURA”, rather than “NURAPHONE”. Although the word “NURAPHONE” appears in the URL/internet address window as well as next to the goods as “THE NURAPHONE”, neither of these are acceptable displays of use of the mark in connection with retail store services. This is because when a mark appears in the computer browser area as part of the URL, Internet address, or domain name of the website that houses the web page, consumers generally do not recognize this as trademark use; rather, it merely identifies the Internet location of the website where business is conducted and goods or services are offered. TMEP §904.03(i)(B)(2). See, e.g., In re Roberts, 87 USPQ2d 1474, 1479-80 (TTAB 2008) (concluding that the mark IRESTMYCASE, which appeared as part of a website address, www.irestmycase.com, on applicant’s specimens, merely served as a contact address to reach the applicant and failed to function as a service mark for applicant’s services); In re Supply Guys, Inc., 86 USPQ2d 1488, 1493 (TTAB 2008) ( "[A]pplicant’s use of the term LEADING EDGE TONERS as part of the internet address, www.leadingedgetoners.com, . . . identifies the website where applicant conducts its retail sales services. Obviously, a website can be used for multiple purposes and the simple fact that a term is used as part of the internet address does not mean that it is a trademark for the goods sold on the website."); In re Eilberg, 49 USPQ2d 1955, 1956 (TTAB 1998) (finding that the mark WWW.EILBERG.COM, when displayed in relatively small and subdued typeface below other contact information on applicant’s letterhead, merely indicated the Internet location of applicant’s website rather than functioning as a service mark for applicant’s legal services).
Similarly, the words “THE NURAPHONE” next to the headphones for sale indicate the name of the goods, rather than a trademark used as a source identifier for retail store services. For webpages to be acceptable specimens to show a mark-services association, it is customary to display service marks near the top of the webpages on which the services are advertised or through which they are accessed or rendered. See TMEP 1301.04(i).
An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each international class of services identified in the statement of use. 15 U.S.C. §1051(a)(1); 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).
Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and webpages that show the mark used in the actual sale, rendering, or advertising of the services. See TMEP §1301.04(a), (h)(iv)(C). And, as stated above, specimens comprising advertising or promotional materials must show a direct association between the mark and the services. In re WAY Media, Inc., 118 USPQ2d at 1698 (quoting In re Universal Oil Prods. Co., 476 F.2d at 655, 177 USPQ at 457); TMEP §1301.04(f)(ii).
Applicant may respond to this refusal by submitting, for each applicable international class, a different specimen (a verified “substitute” specimen) that (a) was in actual use in commerce prior to the expiration of the deadline for filing the statement of use and (b) shows the mark in actual use in commerce for the services identified in the statement of use. A “verified substitute specimen” is a specimen that is accompanied by the following statement made in a signed affidavit or supported by a declaration under 37 C.F.R. §2.20: “The substitute (or new, or originally submitted, if appropriate) specimen(s) was/were in use in commerce prior to expiration of the filing deadline for a statement of use.” The substitute specimen cannot be accepted without this statement.
Applicant, however, may not withdraw the statement of use. See 37 C.F.R. §2.88(f); TMEP §1109.17.

Registration is refused because the specimen does not show the applied-for mark in use in commerce in International Class 38. Specifically, the specimen is described as a “screen grab of a website explaining the services provided under the mark nuraphone, specifically explaining that ‘the hearing profile is transmitted to your nuraphone over the Internet.’” However, these services appear ancillary to the Class 9 goods and to the data and services listed in Classes 41 and 42, rather than telecommunications services that allow people to communicate, such as providing fiber optic network services or local and long distance transmission of messages or carriers facilitating personal communication, such as services that bundle voice communications, numeric and text messaging, voice-mail into one device, contract and bill.

INFORMATION ABOUT SERVICES REQUIRED
1. Is applicant a telecommunications service provider?
2. Please describe the purpose, function and means of providing the Class 38 services.
3. Is the “transmission of information regarding personalized audio content” required for the Class 9 goods (i.e., headphones) to work properly for the consumer?
4. Are the “communication services for delivering personalized audio material by means of the communications networks, wireless communication networks and/or the Internet” part of and/or required for the Class 9 goods (i.e., headphones) to work properly for the consumer?
Factual information about the services must clearly indicate what the services are and how they are rendered, their salient features, and their prospective customers and channels of trade. Conclusory statements regarding the services will not satisfy this requirement for information.
Failure to comply with a request for information is grounds for refusing registration. In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814. Merely stating that information about the services is available on applicant’s website is an insufficient response and will not make the relevant information of record. See In re Planalytics, 70 USPQ2d 1453, 1457-58 (TTAB 2004).
PARTIAL ABANDONMENT ADVISORY
If applicant does not respond to this Office action within the six-month period for response, International Classes 35 and 38 will be deleted from the application. The application will then proceed with International Classes 9, 41 and 42 only. See 37 C.F.R. §2.65(a)-(a)(1); TMEP §718.02(a).
