Good morning, Qian Hongxiu:
I am the assigned trademark examining attorney for the above-referenced application.
Please indicate whether the following amendments are authorized to put the application in condition for publication:
· Delete the goods listed as “Based on Use in Commerce” from the Identification of Goods. Otherwise, the application will be refused for failure to provide a specimen showing use in commerce and for identifying identical goods as both “Based on Use in Commerce” and “Based on Intent to Use” in violation of TMEP § 806.02(a).
· Amend the Description of Mark to state: The mark consists of the wording “ANTLUX” in stylized font wherein the top of the “T” is formed by the stylized head of an ant.
· Amend the Colors Claimed to state: The color(s) black and white is/are claimed as a feature of the mark.
Please indicate by TOMORROW, FRIDAY, AUGUST 3, 2018, as to whether the above amendments are authorized. If so, I will issue an Examiner’s Amendment and approve the mark for publication. Otherwise, the mark will be refused.
