I am the assigned trademark examining attorney for the above-referenced application. I am writing because I recently reviewed the above-referenced application and there are a few issues that I believe we can resolve easily by e-mail or phone. Specifically, below are the issues that will need to be resolved before the application may proceed:
US Trademark Application No. 87821193 GO2
1. Mark on Specimen Does Not Match The Drawing: The mark on the specimen provided does not appear to match the drawing of the mark. While the drawing of the mark has two squares, on around the O2 and one around the G and the smaller square, the specimen shows only the square around the O2. While the specimen has a larger square that houses the aforementioned portion, it is much larger and includes additional matter not in the drawing.
With your permission, I can manually delete the outside square in the drawing so it matches the mark as displayed on the specimen.
2. Mark Description: If you agree to amending the drawing, the mark description would need to be changed to reflect that. If you agree to amend the drawing, with your permission, I will amend the mark description, if accurate, to:
The mark consists of the letter "G" to the left of a square and the letter "O" and the numeral "2” in subscript form inside the square.
Please respond to this email or call me at the number listed below to confirm the potential Examiner’s Amendment for the issue above before 5:00pm EST on Thursday, June 21, 2018. After issuance of this Examiner’s Amendment, the trademark examining attorney will immediately suspend the application based on a prior-pending application, Serial No. 87233530. I can also issue a Priority Action if your client needs more time to consider the issue. If you are unable to respond, an Office action will issue.
