TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62, 2.65(a); TMEP §§711, 718.03.
SEARCH OF OFFICE RECORDS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
SUMMARY OF ISSUES TO WHICH APPLICANT MUST RESPOND:
· Requirement for an Acceptable Identification of Services
REQUIREMENT FOR ACCEPTABLE IDENTIFICATION OF SERVICES
The identification of services is indefinite and must be clarified. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.
Specifically, the following wording is unacceptable:
Telecommunication services – This wording must be amended to identify the specific type of telecommunication services, e.g., “local and long distance transmission of voice, data, graphics and video via broadband optical or wireless networks,” “providing e-mail notification alerts via the internet,” “transmission of podcasts,” “gateway services,” “ISDN services,” “personal communication services,” etc.
Applicant may adopt the following identification of services (noting that the wording which should be deleted is in strikethrough, while newly-added wording is in bold, and appropriate wording should be provided by applicant where a “blank space” (underline) is
indicated):
Telecommunication services, namely, personal communication services; electronic transmission of data, images and documents; streaming of audio, visual and audiovisual material via the Internet; video-on-demand transmission services; television broadcasting services; cable television broadcasting; radio broadcasting services; podcasting services
In the identification of services, applicant must use the common commercial or generic names for the services, be as complete and specific as possible, and avoid the use of indefinite words and phrases. TMEP §1402.03(a); see 37 C.F.R. §2.32(a)(6). If applicant uses indefinite words and phrases such as “services in connection with,” “including,” “and like services,” “concepts,” or “not limited to,” such wording must be followed by “namely,” and a list of each specific service identified by its common commercial or generic name. See TMEP §1402.03(a).

RESPONSE GUIDELINES – PARTIAL REFUSALS/REQUIREMENTS
For this application to proceed further for the full list of applicant’s services, applicant must explicitly address each refusal and/or requirement raised in this Office action. If the action includes a refusal, applicant may provide arguments and/or evidence as to why the refusal should be withdrawn and the mark should register. Applicant may also have other options specified in this Office action for responding to a refusal and should consider such options carefully. To respond to requirements and certain refusal response options, applicant should set forth in writing the required changes or statements. If applicant does not respond to this Office action within six months of the issue/mailing date, the following services will be deleted from the application:
See 37 C.F.R. §2.65(a); TMEP §718.02(a). The application will then proceed with the following services only:
Electronic transmission of data, images and documents; streaming of audio, visual and audiovisual material via the Internet; video-on-demand transmission services; television broadcasting services; cable television broadcasting; radio broadcasting services; podcasting services.
See TMEP §718.02(a). In such case, an applicant may timely file a petition to revive the abandoned services, which, if granted, would allow for the reinsertion of these services into the application. See 37 C.F.R. §2.66; TMEP §§718.02(a), 1714. The petition must be filed within two months of the date of issuance of the notice of abandonment and may be filed online via the Trademark Electronic Application System (TEAS) with a $100 fee. See 37 C.F.R. §§2.6(a)(15)(ii), 2.66(a)(1), (b)(1).
