This Office action is in response to applicant’s communication filed on October 19, 2018.

 

In a previous Office action dated May 22, 2018, the trademark examining attorney refused registration of the applied-for mark based on the following:  Trademark Act Sections 1 and 45 for digitally altered specimens.  In addition, applicant was required to satisfy the following requirement:  provide the requested information about applicant’s specimens.

 

Based on applicant’s response, the trademark examining attorney maintains and now makes FINAL the refusal and requirement in the summary of issues below.  See 37 C.F.R. §2.63(b); TMEP §714.04.

 

SUMMARY OF ISSUES MADE FINAL that applicant must address:

 

  • Sections 1 and 45 Refusal – Digitally Altered or Mock-Up Specimen
  • Information About Specimen Required

 

SECTIONS 1 and 45 REFUSAL – DIGITALLY ALTERED SPECIMEN

 

The refusal to register the applied-for mark in International Class 14 is now made final because the record does not contain a specimen showing the mark in use in commerce.  Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a), 2.63(b); TMEP §§904, 904.07(a). 

 

Applicant was previously refused registration in International Class 14 because the specimens submitted depicted applicant’s goods with digitally altered labels featuring applicant’s proposed mark, including digitally altered images of a third party’s goods.  Therefore, it appeared as if the specimens were created for the purposes of submission in an attempt to show future use of the mark in commerce in connection with the identified goods.  An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each international class of goods and/or services identified in the application or amendment to allege use.  15 U.S.C. §1051(a)(1); 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a). 

 

In response to the refusal, applicant provided a substitute specimen. In this case, the attached Internet evidence from Zolean.com and Bubble-Jimmy Stores establishes that applicant’s substitute specimen depicts a photograph of a third party’s goods for sale on applicant’s websites under the proposed mark, “PORTZON”, indicating that its substitute specimen has been created for the purposes of the present application and do not show actual use in commerce.  The website depicted in applicant’s substitute specimen was not accessible on the date of this Office action, suggesting that applicant’s website evidence may itself be a digitally altered image, and therefore not an acceptable specimen showing use in commerce. See the attached screenshot showing the link identified in the response and that the website www.perfcouple.com are not accessible. Actual “use in commerce” occurs when the mark is placed on the goods or their containers in the ordinary course of trade and the goods are actually sold or transported, and not merely to reserve a right in the mark.  See 15 U.S.C. §1127; TMEP §901.01.

 

A digitally altered image, mock-up, or photograph of an intended depiction of a mark on a label, tag, or piece of paper placed on top of an applicant’s or a third party’s goods or packaging merely for the purposes of filing a trademark application is generally not acceptable to show applicant’s use of the applied-for mark in commerce.  See 15 U.S.C. §1127; TMEP §§904.03(a), 904.04(a), 904.07(a); cf. In re Chica, Inc., 84 USPQ2d 1845, 1848 (TTAB 2007); In re The Signal Cos., 228 USPQ 956, 957-58 n.4 (TTAB 1986).  Applicant must show the mark used on applicant’s goods or packaging as it is seen by the purchasing public, with goods that are sold or transported in commerce that is regulated by the U.S. Congress.  See 15 U.S.C. §1127; TMEP §901.01. 

 

Applicant may respond to this refusal by satisfying one of the following for each applicable international class:

 

(1)       Submit a different specimen (a verified “substitute” specimen) that (a) was in actual use in commerce at least as early as the filing date of the application or prior to the filing of an amendment to allege use and (b) shows the mark in actual use in commerce for the goods identified in the application or amendment to allege use.  A “verified substitute specimen” is a specimen that is accompanied by the following statement made in a signed affidavit or supported by a declaration under 37 C.F.R. §2.20:  “The substitute (or new, or originally submitted, if appropriate) specimen(s) was/were in use in commerce at least as early as the filing date of the application or prior to the filing of the amendment to allege use.”  The substitute specimen cannot be accepted without this statement.

 

(2)       Amend the filing basis to intent to use under Section 1(b), for which no specimen is required.  This option will later necessitate additional fee(s) and filing requirements such as providing a specimen.

To submit a verified specimen or verified substitute specimen online using the Trademark Electronic Application System (TEAS) response form, (1) answer “Yes” to form wizard question #2; and then, continuing on to the next portion of the form, under the heading “Classification and Listing of Goods/Services/Collective Membership Organization,” do the following for each relevant class for which a specimen is being submitted:  (2) check the box next to the following statement:  “Check here to modify the current classification number; listing of goods/services/the nature of the collective membership organization; dates of use; and/or filing basis; or to submit a substitute specimen, a foreign registration certificate, or proof of renewal of a foreign registration.  If not checked, the changes will be ignored.”; (3) under “Specimen File,” attach a specimen (attachment may not exceed 5 megabytes); (4) describe in the box below where you attached the file what the specimen consists of; and (5) check the box next to the following statement below the specimen description (to ensure that the declaration language is inserted into the form): “The substitute (or new, or originally submitted, if appropriate) specimen(s) was/were in use in commerce at least as early as the filing date of the application” [for an application based on Section 1(a), Use in Commerce] OR “The substitute (or new, or originally submitted, if appropriate) specimen(s) was/were in use in commerce prior either to the filing of the Amendment to Allege Use or expiration of the filing deadline for filing a Statement of Use” [for an application based on Section 1(b) Intent-to-Use].  Additionally, when submitting a verified specimen, the TEAS online form requires two signatures: one in the “Declaration Signature” section and one in the “Response Signature” section.

 

INFORMATION ABOUT SPECIMEN REQUIRED

 

Applicant was previously required to provide requested information about applicant’s specimen. However, applicant’s response failed to answer all of the questions below, and applicant’s assertion that its goods are sold on its website are belied by the fact that applicant’s website does not appear to be functioning. Therefore, the requirement that applicant fully answer the questions below is maintained and now made final; in particular, applicant must provide copies of invoices, bills of sale, or other documentation of sales of applicant’s goods, and applicant must provide photos showing applicant’s goods for sale in the actual online sales environment as it is available to the consuming public.

 

Further, applicant asserted that its goods were sold online and provided a URL and a screen capture of a website with its substitute specimen which was not accessible as a live Internet webpage by the examining attorney. Applicant was advised in the previous request for information that if sold online, applicant must identify the websites and provide copies of the webpages showing the goods for sale, the URL for the webpage, and identify the date the webpage was downloaded or accessed.  Thus, to the extent applicant is also using the substitute specimen to respond to the request for information, then applicant’s internet materials have not been properly made of record and are objected to.  Although applicant discussed the contents of webpages as evidence against the refusal and requirement, applicant provided only the web address and an image file of the webpage, which is not sufficient to introduce the underlying webpages into the record.  In re Olin, 124 USPQ2d 1327, 1331 n.15 (TTAB 2017) (citing In re Powermat Inc., 105 USPQ2d 1789, 1791 (TTAB 2013); In re HSB Solomon Assocs., LLC, 102 USPQ2d 1269, 1274 (TTAB 2012)); TBMP §1208.03; TMEP §710.01(b).  Specifically, applicant did not include the date the screenshot was downloaded or accessed.

 

To properly introduce Internet evidence into the record, an applicant must provide (1) an image file or printout of the downloaded webpage, (2) the date the evidence was downloaded or accessed, and (3) the complete URL address of the webpage.  See In re I-Coat Co., LLC, 126 USPQ2d 1730, 1733 (TTAB 2018); see TMEP §710.01(b).

 

A specimen must show the mark as used in commerce, which means use in the ordinary course of trade (not merely to reserve a right in the mark).  15 U.S.C. §§1051, 1052, 1127.  A specimen shows a mark used in commerce for goods only if it shows the mark placed on the goods, packaging, tags or labels affixed to the goods, or displays of the goods, and the goods are actually sold or transported for sale in commerce.  15 U.S.C. §1127.  Because the specimen of record appears to be digitally created or altered, or otherwise a mock-up, it does not appear to show the mark as actually used in commerce.  Therefore, to permit proper examination of the application, applicant must submit additional information for the record about the specimen and how the mark as shown in the specimen is in use in commerce with applicant’s goods.  See 37 C.F.R. §2.61(b); TMEP §814.

 

Accordingly, applicant must respond to the following questions and requests for documentation to satisfy this request for information:

 

(1)       Please provide copies of invoices, bills of sale, or other documentation of sales of the goods.

 

(2)       How do applicant’s goods appear in the actual sales environment?  If sold in stores, provide photos showing the goods for sale in the stores.  If sold online, identify the websites and provide copies of the webpages showing the goods for sale.  And if sold in another type of sales environment, provide photos and/or documentation showing the goods for sale in that environment.

 

(3)       If the information in question (2) about how the goods appear in the actual sales environment is not available to applicant, then please describe how applicant’s goods are transported for sale and provide photos and other documentation showing how applicant’s mark appears on the goods and/or its packaging when the goods are being transported for sale.

Failure to comply with a request for information is grounds for refusing registration.  In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814.  Merely stating that information is available on applicant’s website is an insufficient response and will not make the relevant information of record.  See In re Planalytics, Inc., 70 USPQ2d 1453, 1457-58 (TTAB 2004).

 

RESPONSE GUIDELINES

 

Applicant must respond within six months of the date of issuance of this final Office action or the application will be abandoned.  15 U.S.C. §1062(b); 37 C.F.R. §2.65(a).  Applicant may respond by providing one or both of the following:

 

(1)       a response filed using the Trademark Electronic Application System (TEAS) that fully satisfies all outstanding requirements and/or resolves all outstanding refusals; and/or

 

(2)       an appeal to the Trademark Trial and Appeal Board filed using the Electronic System for Trademark Trials and Appeals (ESTTA) with the required filing fee of $200 per class.

In certain rare circumstances, an applicant may respond by filing a petition to the Director pursuant to 37 C.F.R. §2.63(b)(2) to review procedural issues.  TMEP §714.04; see 37 C.F.R. §2.146(b); TBMP §1201.05; TMEP §1704 (explaining petitionable matters).  There is a fee required for filing a petition.  37 C.F.R. §2.6(a)(15).

 

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
