TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

THIS IS A FINAL ACTION.
This FINAL Office action is being issued in response to applicant’s communication filed June 26, 2018. For the reasons outlined below, the mark description requirement is maintained and made FINAL.
MARK DESCRIPTION AMENDMENT REQUIRED
In the prior Office action, applicant was required to submit an amended mark description because the mark description as originally filed was incomplete. In its response, applicant submitted a mark description that indicates that the design element is used to create the letter “E” in the word “EJECT.” However, the word “EJECT” has a letter “E” that is separate and distinct from the design. Therefore, applicant’s description is inaccurate.
Therefore, applicant must provide a more accurate description of the applied-for mark. The following is suggested:
The mark consists of the word “EJECT” in large capital letters beneath the design of a bullhorn facing left with a fist emerging from the center of the horn, giving the appearance of a letter “E”.
FINAL REFUSAL RESPONSE GUIDELINES
Applicant must respond within six months of the date of issuance of this final Office action or the application will be abandoned. 15 U.S.C. §1062(b); 37 C.F.R. §2.65(a). Applicant may respond by providing one or both of the following:
(1) a response filed using the Trademark Electronic Application System (TEAS) that fully satisfies all outstanding requirements and/or resolves all outstanding refusals; and/or
(2) an appeal to the Trademark Trial and Appeal Board filed using the Electronic System for Trademark Trials and Appeals (ESTTA) with the required filing fee of $200 per class.
