I have reviewed your client’s trademark application serial no. 87768356 and found no conflicting marks. However, my research has shown that the applied-for mark is primarily merely a surname. The Office does not allow surname marks on the Principal Register without a showing of acquired distinctiveness. Thus, please advise if applicant is willing to amend to the supplemental register. If so, I can note the change via Examiner’s Amendment. Alternatively, please advise if applicant would prefer the Office Action.
