Issue date:  September 24, 2021

 

The child application that registered on September 21, 2021, SN 87983966, and is in good standing as it identified goods based on use and the fees were paid.

 

However, the parent application, SN 87739201, is missing Classes 3, 6, and 20 and possibly some goods and/or services in other classes. 

 

Please clarify what good/services that you would like to keep in the parent applicant and then pay any missing fees.  To amend the basis to 44(e), you must file a petition.  Additional fees for the fifth extension for the missing classes that the applicant has indicated they would like to have move forward to registration under Section 44(e) are due.

 

The petition could be filed now but, if you do it now, another division will have to be filed and we are not able to do a partial amendment of basis right now.  If you would like to avoid another division, you can file the petition along with the SOU that is due by January 15, 2022.
