Search Results-No Conflicting Marks Noted
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
Recitation of Services
The identification of services is indefinite and must be clarified because the wording “scientific and technological services in the nature of neuromarketing, namely, developing new sales strategies and customer classification, and computer-aided design services relating thereto” combines services, which are classified in more than one International Class. Specifically, services in the nature of developing sales strategies are classified in International Class 35. In addition, enclosed evidence from http://en.wiktionary.org/wiki/neuromarketing indicates that “neuromarketing” is a marketing activity. As such, clarification of the current wording is required. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Applicant must amend the identification to specify the common commercial or generic name of the services. See TMEP §1402.01. If the services have no common commercial or generic name, applicant must describe or explain the nature of the services using clear and succinct language. See id.
Applicant may adopt the following wording, if accurate:

Applicant may amend the identification to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended. See 37 C.F.R. §2.71(a); TMEP §1402.06. Generally, any deleted goods and/or services may not later be reinserted. See TMEP §1402.07(e).

Requirements of a Multi-Class Application under Section 1(b)
(1) List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.
(2) Submit a filing fee for each international class not covered by the fee already paid (view the USPTO’s current fee schedule). The application identifies services that are classified in at least 2 classes; however, applicant submitted a fee sufficient for only 1 class. Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

Disclaimer Required
The attached evidence from http://en.wiktionary.org/wiki/engagement indicates that the term “ENGAGEMENT” is defined as “the feeling of being compelled, drawn in, connected to what is happening, interested in what will happen next.” The evidence from http://www.merriam-webster.com/dictionary/optimize indicates that “OPTIMIZE” is defined as “to make as perfect, effective, or functional as possible.” It also indicates that “OPTIMIZER” is the noun form of this term and, therefore, refers to an item or service that optimizes.
In this case, applicant has identified scientific, technological and research services all for use in sales, marketing, communications and technology according to the recitation of services. In addition, enclosed advertising from http://callminer.com/learning-center/video-library/callminer-eureka-engagement-optimization/ and http://www.saddletreeresearch.com/ indicates that “engagement optimization” maximizing sales and marketing outcomes. Therefore, the wording “ENGAGEMENT OPTIMIZER” merely describes a function and purpose of the identified services, which are apparently used for engagement optimization.
An applicant may not claim exclusive rights to terms that others may need to use to describe their goods and/or services in the marketplace. See Dena Corp. v. Belvedere Int’l, Inc., 950 F.2d 1555, 1560, 21 USPQ2d 1047, 1051 (Fed. Cir. 1991); In re Aug. Storck KG, 218 USPQ 823, 825 (TTAB 1983). A disclaimer of unregistrable matter does not affect the appearance of the mark; that is, a disclaimer does not physically remove the disclaimed matter from the mark. See Schwarzkopf v. John H. Breck, Inc., 340 F.2d 978, 978, 144 USPQ 433, 433 (C.C.P.A. 1965); TMEP §1213.
If applicant does not provide the required disclaimer, the USPTO may refuse to register the entire mark. See In re Stereotaxis Inc., 429 F.3d 1039, 1040-41, 77 USPQ2d 1087, 1088-89 (Fed. Cir. 2005); TMEP §1213.01(b).
Applicant should submit a disclaimer in the following standardized format:
