MARK STATEMENT The mark consists of standard characters, without claim to any particular font style, size or color.
ARGUMENT(S)

The Office Action requires “SAFE” in Applicant’s pending application for CARBONITE SAFE to be disclaimed on the ground that it merely describes a desirable feature of applicant’s goods and services.  Applicant has applied to register CARBONITE SAFE in connection with “[d]ownloadable computer software for online backup of computer content,” in class 9 and “[s]oftware as a service (SAAS) services featuring software for backing up and archiving electronic data; remote computer backup services; remote online backup of electronic computer data; back-up services for computer hard drive data,” in class 42.  Applicant respectfully submits that a disclaimer of “SAFE” is not required because this term is suggestive and not merely descriptive in connection with Applicant’s goods and services.

A term is merely descriptive only if it immediately conveys knowledge of a quality, feature, function, or characteristic of the goods or services with which it is used.  In re Bayer Aktiengesellschaft, 488 F.3d 960, 964 (Fed. Cir. 2007) (citing In re Gyulay, 820 F.2d 1216, 1217 (Fed. Cir. 1987)).  A suggestive term is not rendered merely descriptive, however, simply because the terms have some meaning in relation to the goods or services.  See McCarthy on Trademarks and Unfair Competition, § 11:64, 11-202 (Thompson Reuters 2013) (“The terms “descriptive” and “suggestive” are not mutually exclusive.  There is some description in any suggestion or the suggestive process will not take place.”); see also TMEP § 1209.01(a) (“a designation does not have to be devoid of all meaning in relation to the goods/services to be registerable.”).  Any doubt regarding whether a mark is merely descriptive is to be resolved in favor of the applicant.  In re Conductive Sys., Inc., 220 U.S.P.Q. 84, 86 (T.T.A.B. 1983).  Moreover, the Examining Attorney bears the burden of showing that a mark is merely descriptive of the identified goods or services.  In re Bayer Aktiengesellschaft, 488 F.3d at 964; see also TMEP § 1209.02 (Examining Attorney should support descriptiveness refusal with “appropriate evidence”). 

The word “SAFE” in the pending application is suggestive rather than merely descriptive because it has a dual meaning.  The word “SAFE” has the meaning identified in the Office Action when it is used as an adjective—“protected from being hurt, damaged, lost, stolen, etc.” (See March 7, 2018 Office Action).  But “SAFE” has a second meaning when used as a noun that is relevant to Applicant’s goods and services, namely, “a repository for protecting stored items . . . .” and is synonymous with “strongbox, vault, coffer, repository, deposit box, safe-deposit box, and strongroom.” See Exhibit A (dictionary definition).  Thus, the term SAFE as used here evokes two meanings: one that suggests a user’s data will be safe and a second that suggests the Applicant’s goods and services are the software-equivalent of a traditional physical safe or vault.

Where, as here, a term has dual meanings, it is suggestive rather than descriptive.  See In re Del. Punch Co., 186 USPQ 63 (TTAB 1975) (THE SOFT PUNCH for noncarbonated soft drink held registrable because of dual meaning); In re National Tea Co., 144 USPQ 286 (TTAB 1965) (NO BONES ABOUT IT for fresh pre-cooked ham held registrable because of dual meaning).  Because there will likely be a delay and a level of imagination required to associate the mark with any attribute of the goods and services, the term SAFE is not merely descriptive, and need not be disclaimed.

A review of the USPTO database further confirms that no disclaimer should be required.  Numerous marks containing “SAFE” are registered on the Principal Register for goods and services relating to software and computer technology in classes 9 and 42 without any disclaimer of SAFE, even though the term likely suggests one attribute of the software.  For example:
