ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

Applicant respectfully asks that the Examiner reconsider the strength of the marks as to their point of commonality; and, the dominant portion of Registrant?s mark. The Principle Register is replete with registrations that include the word ?uno? and all of its foreign and numerical equivalents. ?1? and its equivalents are an exceedingly common laudatory designation. The unparalleled ubiquity of ?1? as a device used in marks is a fact that speaks for itself and of which consumers are well aware. Thus the dominant portion of Registrants mark is VARIOCELL which serves as a distinctive, powerful and effective device to distinguish the marks. In truth, the marks are quite dissimilar and it would be error to afford Registrant such wide scope based on the similarity of a very weak component.
