The Office Action states that the description “obtaining and providing business and commercial information from computers or sensors relating to the status and conditions in in vehicles, namely, information about vehicle driving history and performance” is not acceptable because the services were not transferred from application Serial No. 87/635,114 (VERISK ANALYTICS in Class 42).  However, essentially the same services were actually transferred from Serial No. 87/635,367 (VERISK & Design in Class 42), which stated “obtaining and providing information from computers or sensors relating to the status and conditions in residential and commercial buildings and in vehicles, namely, vehicle driving history and performance, atmospheric and air quality measurements in buildings, security data, and connected home data.”  Accordingly, Applicant should be permitted to retain these services in Class 40.
