SEARCH OF OFFICE’S DATABASE OF MARKS

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

SECTION 2(e)(2) REFUSAL – PRIMARILY GEOGRAPHICALLY DESCRIPTIVE

 

Registration is refused because the applied-for mark is primarily geographically descriptive of the origin of applicant’s goods.  Trademark Act Section 2(e)(2), 15 U.S.C. §1052(e)(2); see TMEP §§1210, 1210.01(a).

 

The applicant applied to register the mark LOUISVILLE for “Hockey equipment, namely, hockey sticks, goaltender sticks, hockey stick shafts, hockey skates, ice skate blades, skate blade guards, skate blade protective jackets, hockey pucks, hockey balls, hockey goals and nets, hockey gloves, trapper gloves, blockers, body protective articles and equipment specifically designed for hockey, namely, throat protectors, gloves, protective padded hockey pants, body pads, elbow pads, shin guards, leg pads, leg guards, girdles comprising body protective padding, suspenders for use with hockey pants, wrist slash guards, ankle guards, chin protectors, neck guards, mouth guards, and shoulder pads, hockey chest protectors, hockey helmets, visors, face guards, cages, and face masks for such helmets, and hockey equipment bags.”

 

The primary significance of LOUISVILLE is geographic.  Specifically, it is “the largest city of Kentucky, in the north-central part of the state on the Ohio River southwest of Cincinnati. Originally the site of a fort built by George Rogers Clark in 1778, it is now the center of a large metropolitan area and home to the Kentucky Derby.”  American Heritage Dictionary of the English Language.  Copyright 2017 by Houghton Mifflin Harcourt.  (See attachments).

 

Goods are considered to originate from a geographic location when the record shows that the goods are sold there, manufactured or produced there, packaged and shipped from there, and/or contain a main ingredient or component derived from there.  See In re Joint-Stock Co. “Baik,” 80 USPQ2d 1305, 1310 (TTAB 2006) (holding applicant’s vodka originated from BAIKALSKAYA, a Russian word meaning “from Baikal,” because it was made from the water of Lake Baikal and applicant produced various vodkas from a location near Lake Baikal); In re JT Tobacconists, 59 USPQ2d 1080, 1083 (TTAB 2001) (holding applicant’s cigars, cigar cases, and humidors originated from MINNESOTA because they were packaged and shipped from MINNESOTA, and applicant’s business was located in MINNESOTA); TMEP §1210.03.

 

REQUIREMENT FOR INFORMATION

 

Applicant must provide a written statement explaining whether the goods will be manufactured, packaged, shipped from, sold in or will have any other connection with the geographic location named in the mark.  See 37 C.F.R. §2.61(b); TMEP §§814, 1210.03.  Failure to comply with a request for information is grounds for refusing registration.  In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814. 

 

IDENTIFICATION OF GOODS

 

The wording “..., hockey balls, ..., trapper gloves, blockers, ..., hockey helmets, visors, face guards, cages, and face masks for such helmets, and hockey equipment bags,” in the identification of goods is indefinite and must be clarified because it does not identify all of the goods by the full common commercial name and it encompasses goods classified in more than one class.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. 

 

Applicant may substitute the following wording, if accurate: 

 

International Class 9

Hockey helmets, hockey helmet visors, face guards being protective face masks for hockey, and protective face masks for hockey helmets.

 

International Class 18

Hockey equipment bags being sports bags.

 

International Class 28

Hockey equipment, namely, hockey sticks, goaltender sticks, hockey stick shafts, hockey skates, ice skate blades, skate blade guards, skate blade protective jackets, hockey pucks, field hockey balls, hockey goals and nets, hockey gloves, goalie trapper gloves, goalie blockers; body protective articles and equipment specifically designed for hockey, namely, throat protectors, gloves, protective padded hockey pants, body pads, elbow pads, shin guards, leg pads, leg guards, girdles comprising body protective padding, suspenders for use with hockey pants, wrist slash guards, ankle guards, chin protectors, neck guards, mouth guards, and shoulder pads, hockey chest protectors, ball cages, and bags specially adapted for hockey equipment.

 

Applicant may amend the identification to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted goods and/or services may not later be reinserted.  See TMEP §1402.07(e).

 

--Advisory Regarding Supplemental Register

 

A mark in an application under Trademark Act Section 1(b) is not eligible for registration on the Supplemental Register until an acceptable amendment to allege use under 37 C.F.R. §2.76 has been filed.  37 C.F.R. §§2.47(d), 2.75(b); TMEP §§815.02, 1102.03.  When a Section 1(b) application is successfully amended to the Supplemental Register, the application effective filing date will be the date applicant met the minimum filing requirements under 37 C.F.R. §2.76(c) for the amendment to allege use.  TMEP §§816.02, 1102.03; see 37 C.F.R. §2.75(b).

 

Although registration on the Supplemental Register does not afford all the benefits of registration on the Principal Register, it does provide the following advantages to the registrant:

 

(1)       Use of the registration symbol ® with the registered mark in connection with the designated goods and/or services, which provides public notice of the registration and potentially deters third parties from using confusingly similar marks.

 

(2)       Inclusion of the registered mark in the USPTO’s database of registered and pending marks, which will (a) make it easier for third parties to find it in trademark search reports, (b) provide public notice of the registration, and thus (c) potentially deter third parties from using confusingly similar marks.

 

(3)       Use of the registration by a USPTO trademark examining attorney as a bar to registering confusingly similar marks in applications filed by third parties.

 

(4)       Use of the registration as a basis to bring suit for trademark infringement in federal court, which, although more costly than state court, means judges with more trademark experience, often faster adjudications, and the opportunity to seek an injunction, actual damages, and attorneys’ fees and costs.

 

(5)       Use of the registration as a filing basis for a trademark application for registration in certain foreign countries, in accordance with international treaties.

MULTIPLE-CLASS APPLICATION REQUIREMENTS

 

The application identifies goods and/or services in more than one international class; therefore, applicant must satisfy all the requirements below for each international class based on Trademark Act Section 1(b):

 

(1)       List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.

 

(2)       Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule).  The application identifies goods and/or services that are classified in at least three classes; however, applicant submitted a fee(s) sufficient for only one class.  Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
