The petition to the Director of the United States Patent and Trademark Office (USPTO) requesting reversal of the trademark examining attorney’s abandonment of the above-identified application for failure to file a complete response to an Office action issued in connection with the above-referenced application was received on April 9, 2019. The Director has the authority to review this request. See 37 C.F.R. §2.146.
A review of USPTO records indicates that the application was reinstated and that the examining attorney issued a subsequent non-final Office action on August 27, 2019. Please note that a response is due to the Office action within six months of the August 27, 2019 issuance date.
Therefore, your petition to the Director is hereby dismissed as moot. The petition fee will be refunded in due course. See Trademark Manual of Examining Procedure (TMEP) §405.04.
