TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
In response to this Office action, the applicant must address the following issues:
DRAWING DOES NOT REPRODUCE SATISFACTORILY – NEW DRAWING REQUIRED
Therefore, applicant must submit a new drawing showing a clear depiction of the mark. All lines must be clean, sharp and solid, and not fine or crowded. 37 C.F.R. §§2.53(c), 2.54(e); TMEP §§807.05(c), 807.06(a). Additionally, the USPTO will not accept a new drawing in which there are amendments or changes that would materially alter the applied-for mark. 37 C.F.R. §2.72; see TMEP §§807.13 et seq., 807.14.

INCOMPLETE MARK DESCRIPTION – AMENDMENT REQUIRED
Therefore, applicant must provide a more complete description of the applied-for mark. The following is suggested:
The mark consists of the stylized letters “MJ” with an inverted V-shape representing the roof of a structure and constituting an angled top bar of the “J” and with an extension of the left side of the “M” depicting a chimney, the bottom of the “J” curves to form a line under the letter “M” with a series of straight lines going across the bottom portion of the “J”.
INDEFINITE AND MISCLASSIFIED IDENTIFICATION OF SERVICES – AMENDMENT REQUIRED
Therefore, applicant must delete “sales” from the identification and indicate with greater specificity the nature of the service in International Class 35; e.g., “online retail store services featuring carpeting and other flooring,” “online wholesale store services featuring carpeting and other flooring,” and “on-line wholesale and retail store services featuring carpeting and other flooring.”
Applicant may adopt the following identification, if accurate:
Class 35 – “online [applicant to specify, e.g. retail store services, wholesale store services, wholesale and retail store services] featuring carpeting and other flooring.”
Applicant may amend the identification to clarify or limit the services, but not to broaden or expand the services beyond those in the original application or as acceptably amended. See 37 C.F.R. §2.71(a); TMEP §1402.06. Generally, any deleted services may not later be reinserted. See TMEP §1402.07(e).

RESPONSE TO THIS OFFICE ACTON
TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04. However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
