Subject: Trademark Application Serial Nos. 87478122 (BLUESTAR), 87478136 (BLUE STAR) and 87533795 (BLUESTAR)
Good afternoon,
I’m contacting you regarding co-pending Trademark Application Serial Nos. 87478122 (BLUESTAR), 87478136 (BLUE STAR) and 87533795 (BLUESTAR). I received your most recent responses, and the applications are in very good shape. There is one remaining issue with the applicant’s address that must be resolved, which I think we can address via an examiner’s amendment. This issue is the same for all three applications.
Specifically, the applicant must provide its domicile street address, as per the new rules that went into effect on August 3, 2019. See 37 C.F.R. §§2.2(o)-(p), 2.11(a), 2.189; Requirement of U.S.-Licensed Attorney for Foreign-Domiciled Trademark Applicants & Registrants, Examination Guide 4-19, at I.A. (Rev. Sept. 2019).
The application record for all three applications currently lists the applicant as a juristic entity and specifies applicant’s domicile as a post office box instead of a street address. In most cases, a post office box is not acceptable as a domicile address because it does not identify the location of applicant’s headquarters where the entity’s senior executives or officers ordinarily direct and control the entity’s activities. See 37 C.F.R. §§2.2(o)-(p), 2.189; Examination Guide 4-19, at I.A.3. Therefore, the applicant must provide its domicile street address. See 37 C.F.R. §2.189.
If you confirm the applicant’s domicile street address, I would be happy to enter the changes for you via an examiner’s amendment for each application. If you could please reply by Friday, January 3 at 5pm Eastern Time, I would very much appreciate it. If I don’t hear from you by that time, I’ll go ahead and issue the office actions, but I hope to hear from you soon. If you’d prefer to reply via phone, I can be reached at 571-272-4031.
Best regards,
Jessica L. Hilliard
