TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

THIS IS A FINAL ACTION.
This letter responds to applicant’s communication filed on April 10, 2018. The examining attorney acknowledges and has entered into the record applicant’s copy of its foreign registration.
Applicant’s amended identification of goods is unacceptable and the requirement is herein made FINAL.
The identification of goods is indefinite and must be clarified because certain items are overly broad and could refer to goods possibly classified in another international class. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Applicant may adopt the following identification, if accurate:
International Class 6: metal computer cable clips
International Class 9: Telecommunication machines and apparatus, namely, earphones, microphones, speakerphones, and audio speakers; mobile computers and their accessories, namely, carrying cases, holders, specialty holsters adapted for carrying mobile
computers, mounting devices for mounting mobile computer on display monitor, computer cables, clips for computer cables [this item needs clarification
and is classified in either class 6 or 20], battery packs for mobile computer, battery chargers for mobile computer batteries, and computer stands specially design for mobile computers; personal
computers; personal digital assistants; computer programs for remote assistance, teleconferencing, video conferencing, audio conferencing, viewing digital contents, transmitting sounds, images, text
and data via the internet, chatting and text messaging over network, and configuration of mobile computers, personal computers, smartglasses, and personal digital assistants; electronic machines,
apparatus, and their parts, namely, smartglasses, instruments for mounting smartglasses to safety helmets, namely [applicant must specify the common commercial name of the
instruments], head band to fix smartglasses [this item is indefinite because head bands are not typically a tool to fix smartglasses], ear hook attachment for smartglasses, batteries for smartglasses, battery holders for smartglasses, wearable video display monitors devices,
instrument for mounting wearable display devices to eyeglasses or protective glasses namely [applicant must specify the common commercial name of the instruments], batteries for
wearable display devices, and battery holders for wearable display devices
International Class 20: non-metal computer cable clips

(1) List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.
(2) Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule). The application identifies goods and/or services that are classified in at least 5 classes; however, applicant submitted a fee(s) sufficient for only 3 classes. Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

If applicant fails to respond to this final action within six months of the mailing date, the application will be abandoned. 15 U.S.C. §1062(b); 37 C.F.R. §2.65(a). Applicant may respond to this final action by:
(1) submitting a response that fully satisfies all outstanding requirements, if feasible (37 C.F.R. §2.64(a)); and/or
(2) filing an appeal to the Trademark Trial and Appeal Board, with an appeal fee of $100 per class (37 C.F.R. §§2.6(a)(18) and 2.64(a); TMEP §§715.01 and 1501 et seq.; TBMP Chapter 1200).
In certain circumstances, a petition to the Director may be filed to review a final action that is limited to procedural issues, pursuant to 37 C.F.R. §2.63(b)(2). 37 C.F.R. §2.64(a). See 37 C.F.R. §2.146(b), TMEP §1704, and TBMP Chapter 1201.05 for an explanation of petitionable matters. The petition fee is $100. 37 C.F.R. §2.6(a)(15).
TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04. However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
