We can agree to this amendment, though since we can’t take care of both of these issues, we understand if you want to simply issue a refusal on both points.

The Applicant advised us that it has used the mark in the US and we are awaiting from the client the specimen to support the 1(a) claim. Kindly issue the office action. The client is in Germany so it is unlikely we will be able to

It appears that the certificate of registration dropped off when we filed the application. We would like to retain the 44e and can file a preliminary amendment submitting it tomorrow.
