Dear Mr. Doernberg,

 

I hope this email finds you well. I am the new examining attorney for your client’s QUANFIDENCE mark – the former examiner is no longer examining - and there is one issue that was not addressed in the first office action that can be handled by an examiner’s amendment that I want to discuss with you.

 

The last clause in the ID for Class 42 reads “Providing information in the field of mass spectrometers and mass spectrometry.” Unfortunately this clause is indefinite and overly broad because the specific focus of the information is not named which will impact classification. As:

 

Consumer/product purchasing information regarding mass spectrometers would be classified in Class 35:

Providing consumer product information relating to {specify goods, e.g., laptops, software, cosmetics, etc.}

 

Installation/maintenance information for mass spectrometers would be in Class 37:

Providing information related to the installation, maintenance and repair of {indicate specific item, e.g., electrical systems, appliances, windows, etc.}

 

And basic scientific information regarding mass spectrometry would go in Class 42:

Providing scientific information in the field of {indicate field or subject matter}

 

In order to make the clause definite in Class 42 I would suggest “providing scientific information in the field of mass spectrometers and mass spectrometry.” However, you know better than I the nature of the information services provided by your client.
