Real D, Inc. ("Applicant") for the mark REALD ME (the "Proposed Mark"). The Examiner preliminarily refused registration of the Proposed Mark on the ground of a perceived likelihood of confusion
with Registration No. 5,233,213 for the mark REALD INTELILIGHT. On February 13, 2018, that registration was surrendered. A copy of the Surrender paperwork is attached hereto as Exhibit
A. In light of that surrender, Registration No. 5,233,213 no longer stands as a barrier to registration of the Proposed Mark. Applicant therefore respectfully requests that the
Application be allowed to proceed to registration without further delay.
