Response to Suspension Inquiry or Letter of Suspension

To the Commissioner for Trademarks:

Application serial no. 87392905 LOTTE(Standard Characters, see http://uspto.report/TM/87392905/mark.png) has been amended as follows:
FOREIGN REGISTRATION
The applicant herein submits a digitized image of a copy, a certification, or a certified copy of a registration in the applicant's country of origin showing that the mark has been registered in that country, and that the registration is in full force and effect. If the foreign registration is not in English, an English translation thereof is being submitted. The applicant hereby requests removal of this application from suspension for further action by the examining attorney.

Filing Basis: Section 44(e), Based on Foreign Registration: A copy of Korea, South registration number 40-1358020 registered 05/09/2018, with a renewal date of __________ and an expiration date of 05/09/2028, and translation thereof (if appropriate), is attached in accordance with 15 U.S.C. Section 1126(e), as amended.

Accompanying this response is a certified copy of applicant's foreign registration and an English translation of same to support of its Section 44(e) filing basis for class 039 in response to the Suspension Inquiry mailed on April 9, 2018.

Applicant's country of origin is a party to a treaty with the U.S. under 15 U.S.C. Section 1126 (b), and the applicant the owner of a valid registration under 15 U.S.C. Section 1126 (c), (e).

If the application is properly filed based on Section 1(b), and the applicant later amends the application to add or substitute Section 44 as a basis, the applicant must be the owner of the foreign registration as of the filing date of the amendment adding or substituting a section 44 basis for registration under TMEP 1005 and 15 U.S.C. Section 1126 (b).  Here, the current owner of the foreign registration, "LOTTE CORORATION" is same as the applicant of instant application by virtue of Notice of Recordation (Change of Name) recorded at Reel/Frame No. 6353/0212 as attached herewith.

Further, Applicant requests that the Examining Attorney delete the Section 1(b) basis for the services only if the Section 44(e) basis is accepted for those services.

Accordingly, Applicant respectfully requests the Examining Attorney to approve for publication. The Examiner is invited to telephone the undersigned, Applicant’s attorney of record, to facilitate advancement of the present application, if necessary.
