I am the examining attorney at the U.S. Trademark Office reviewing the above listed applications. It appears we have one outstanding issue that precludes me from approving them for publication. Given the nature of the requirement, I am hoping that we can resolve this informally via email or phone.
Specifically, the office requires a disclaimer of “POWER PRODUCTS” apart from the mark as shown, in each file given that it describes the type of goods. Of course, a disclaimer is simply an acknowledgment and does not change the appearance of the mark. With your permission, I suggest the following amendment, if accurate:
No claim is made to the exclusive right to use “POWER PRODUCTS” apart from the mark as shown.
Please respond back to this email with your acceptance of the suggested amendment or your concerns. Once your permission is received, I will issue an Examiner’s Amendment to update our database and move the files forward to publication. If I do not hear back from you in the next few business days, I will issue an office action giving you more time to respond to the requirement.
