The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

DISCLAIMER REQUIRED

 

Applicant must disclaim the wording “FAMOUS FOR MILKSHAKES” because it is laudatory (attributes quality or excellence) and thus merely describes the alleged merit of applicant’s goods and/or services.  See 15 U.S.C. §§1052(e)(1), 1056(a); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1256, 103 USPQ2d 1753, 1759 (Fed. Cir. 2012); TMEP §1209.03(k).

 

“Self-laudatory or puffing marks are regarded as a condensed form of describing the character or quality of the goods [or services].”  DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d at 1256, 103 USPQ2d at 1759 (quoting In re The Boston Beer Co., 198 F.3d 1370, 1373, 53 USPQ2d 1056, 1058 (Fed. Cir. 1999)).  Thus, wording such as “ultimate,” “best,” “greatest,” and the like are generally considered laudatory and descriptive of an alleged superior quality of the goods and/or services.  See In re Nett Designs, Inc., 236 F.3d 1339, 1342, 57 USPQ2d 1564, 1566 (Fed. Cir. 2001); In re The Boston Beer Co., 198 F.3d at 1373-74, 53 USPQ2d at 1058-59; In re The Place, Inc., 76 USPQ2d 1467, 1468 (TTAB 2005); TMEP §1209.03(k).

 

The identification of goods and services includes milkshakes and restaurants where milkshakes are served.  Therefore, this wording is merely laudatory of the supposed superior quality of the goods and/or services.

 

An applicant may not claim exclusive rights to terms that others may need to use to describe their goods and/or services in the marketplace.  See Dena Corp. v. Belvedere Int’l, Inc., 950 F.2d 1555, 1560, 21 USPQ2d 1047, 1051 (Fed. Cir. 1991); In re Aug. Storck KG, 218 USPQ 823, 825 (TTAB 1983).  A disclaimer of unregistrable matter does not affect the appearance of the mark; that is, a disclaimer does not physically remove the disclaimed matter from the mark.  See Schwarzkopf v. John H. Breck, Inc., 340 F.2d 978, 979-80, 144 USPQ 433, 433 (C.C.P.A. 1965); TMEP §1213.

 

If applicant does not provide the required disclaimer, the USPTO may refuse to register the entire mark.  See In re Stereotaxis Inc., 429 F.3d 1039, 1040-41, 77 USPQ2d 1087, 1088-89 (Fed. Cir. 2005); TMEP §1213.01(b).

 

Applicant should submit a disclaimer in the following standardized format:

 

No claim is made to the exclusive right to use “FAMOUS FOR MILKSHAKES” apart from the mark as shown.

AMENDED DRAWING OF THE MARK

 

Applicant must submit a new drawing showing the ® symbol deleted from the mark; this matter is not part of the mark and is not registrable.  See TMEP §807.14(a). 

 

MARK INCLUDES NAME OF AN INDIVIDUAL – CONSENT REQUIRED

 

Applicant must clarify whether the signature of BIGLARI in the mark identifies a particular living individual.  See 37 C.F.R. §2.61(b); TMEP §§813, 1206.03.  In this case, the application neither specifies whether the name in the mark identifies a particular living individual nor includes a written consent.  See TMEP §§813.01(a)-(b), 1206.04(a), 1206.05.  It is noted that one of the applicants is the named individual; however, this individual did not personally sign the application so consent cannot be presumed from the application.  TMEP §813. 

 

To register a mark that consists of or comprises the signature of the name of a particular living individual, including a first name, pseudonym, stage name, or nickname, an applicant must provide a written consent personally signed by the named individual.  15 U.S.C. §1052(c); TMEP §§813, 1206.04(a).  

 

Therefore, applicant must submit both of the following: 

 

(1)  The following statement:  “The signature(s) shown in the mark identifies a living individual(s) whose consent(s) to register is made of record.”  If the name is a pseudonym, stage name, or nickname, applicant must provide the following statement: Biglari identifies Sardar Biglari, a living individual whose consent is of record.”

 

(2)  A written consent, personally signed by the named individual(s), as follows:  “I, Sardar Biglari, consent to the use and registration of the signature of my name, BIGLARI, as a trademark and/or service mark with the USPTO.”

PAYMENT OF ADDITIONAL FEE REQUIRED – TEAS PLUS REQUIREMENTS NOT MET

 

Applicant must submit an additional processing fee of $50 per class because the application as filed did not meet the TEAS Plus application filing requirements.  See 37 C.F.R. §§2.6(a)(1)(v), 2.22(a), (c); TMEP §§819.01 et seq., 819.04.  Specifically, applicant failed to meet the following application filing requirement(s):  a consent to register the mark from the person identified in the mark (or conversely, if appropriate, a statement that the name or portrait in the mark does not identify a living individual) was not provided. 

 

The additional fee is required even if applicant later corrects these application requirements.
