Dear Mr. Rinker,
Thank you for your response. We will concede the clothing goods/Class 10 issue and modify the identifications of the goods to reflect your suggestions on page 2 of the Office Action (beginning with “Applicant may change this wording to following if accurate.”).
With regard to the “barrier garments” issue, we would like to adjust the definition to sufficiently reflect the medical purpose of the Goods. Unfortunately, we believe that the suggested language “barrier garments, namely, dental dams incorporating a garment for application of the dental dam to the user” does not accurately describe the Goods. First, the Goods cover bodily areas beyond what is covered by a dental dam, which is typically a 6”x8” sheet. Second, unlike harness-like devices that hold a dental dam in place, the Goods are one seamless item and do not contain a dental dam portion that is applied to the body using a garment portion.
We believe that each of the descriptions below reflects the medical/prophylactic nature of the Goods yet describes them more accurately. Would any one of these descriptions suffice? If not, we will delete the “barrier garment” language in our modification of the identification of the goods.
- Barrier garments, namely barriers shaped like undergarments that are worn during cunnilingus and anilingus to prevent the transmission of sexually transmitted infections, taste, and scent
- Barrier garments, namely prophylactics shaped like undergarments that are worn during cunnilingus and anilingus
- Barrier garments, namely thin elastomeric material in the form of garments that are used as prophylactic devices during cunnilingus and anilingus
- Barrier garments, namely garments incorporating a prophylactic device for use during cunnilingus and anilingus
