SEARCH CLAUSE – NOTWITHSTANDING ONE PRIOR PENDING APPLICATION
APPLICANT NOT ENTITLED TO REGISTER – ONE EARLIER-FILED PENDING APPLICATION – Applicant May Present Arguments
In response to this Office action, applicant may present arguments in support of registration by addressing the issue of the potential conflict between applicant’s mark and the mark in the referenced application. Applicant’s election not to submit arguments at this time in no way limits applicant’s right to address this issue later if a refusal under Section 2(d) issues.
DISCLAIMER
Applicant must disclaim the wording “HEALTH” because it merely describes an ingredient, quality, characteristic, function, feature, purpose, or use of applicant’s goods and/or services, and thus is an unregistrable component of the mark. See 15 U.S.C. §§1052(e)(1), 1056(a); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012) (quoting In re Oppedahl & Larson LLP, 373 F.3d 1171, 1173, 71 USPQ2d 1370, 1371 (Fed. Cir. 2004)); TMEP §§1213, 1213.03(a).
An applicant may not claim exclusive rights to terms that others may need to use to describe their goods and/or services in the marketplace. See Dena Corp. v. Belvedere Int’l, Inc., 950 F.2d 1555, 1560, 21 USPQ2d 1047, 1051 (Fed. Cir. 1991); In re Aug. Storck KG, 218 USPQ 823, 825 (TTAB 1983). A disclaimer of unregistrable matter does not affect the appearance of the mark; that is, a disclaimer does not physically remove the disclaimed matter from the mark. See Schwarzkopf v. John H. Breck, Inc., 340 F.2d 978, 978, 144 USPQ 433, 433 (C.C.P.A. 1965); TMEP §1213.
The applicant has applied for the mark HEALTH MART for “House mark for a full line of non-prescription and over the counter pharmaceutical and first aid products.” The term HEALTH is defined as “Soundness, especially of body or mind; freedom from disease or abnormality.” American Heritage Dictionary of the English Language, http://www.ahdictionary.com/word/search.html?q=health (visited on November 23, 2016). See attached definitions. See also attached registrations that include a disclaimer of HEALTH. The applicant provides health care products including non-prescription and over the counter pharmaceuticals and first aid products used to improve one’s health. Accordingly, the term HEALTH is merely descriptive of a feature, characteristic or purpose of the applicant’s goods and/or services and must be disclaimed.
Applicant should submit the following standardized format for a disclaimer:
No claim is made to the exclusive right to use “HEALTH” apart from the mark as shown.
TMEP §1213.08(a)(i); see In re Owatonna Tool Co., 231 USPQ 493, 494 (Comm’r Pats. 1983).
HOUSE MARK
Therefore, applicant must submit evidence of use of the mark as a house mark, such as product catalogs or similar materials showing broad use of the mark. TMEP §1402.03(b). If applicant cannot provide such evidence, applicant must amend the identification to (1) delete “house mark for” and (2) specify the common commercial or generic name for each item, if not already specified. See TMEP §§1402.01, 1402.03(b). Use on three pharmaceuticals is insufficient to establish a house mark for a full line of non-prescription and over the counter pharmaceutical and first aid products.
TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $50 per international class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04. However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
