Petition to Amend Basis Post-Publication

To the Commissioner for Trademarks:

The following is submitted for application serial number. 87093828

FORM INFORMATION

Pursuant to TMEP Sec. 806.03(j), Applicant respectfully requests that its application be returned to the Examining Attorney so that the Examining Attorney may remove the 1(b) filing basis and replace such basis with 44(e), based on the attached Japanese registration and translation. The relevant registration no. is 4574905, the registration date is June 7, 2002, and the expiration date is June 7, 2022. The goods listed in the Japanese registration cover the goods listed in the pending application. If for any reason the Director or Examining Attorney determines that the 44(e) basis is not proper, then and only then does Applicant wish to retain the 1(b) basis currently assigned to its application. Otherwise, deletion of 1(b) and addition of 44(e) is requested.
