Response to Office Action

To the Commissioner for Trademarks:

Application serial no. 87083202 NEST (Stylized and/or with Design, see ) has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

The Examining Attorney issued an initial refusal of the Application on the basis of Section 2(d) and citing U.S. Reg. No. 4569914 as a prior registration (the "Registration").

At the time of the Office Action, the Registration was owned by Airstream, Inc. 

By assignment dated November 11, 2016, Airstream, Inc. assigned all right, title and interest in the Registration, along with all associated goodwill, to the Applicant. See attached Assignment of Trademark.

Applicant recorded the Assignment with the USPTO at Reel 5918/Frame 0633. See attached Notice of Recordation of Assignment Document.

The cited Registration and the present Application are now owned by the same entity, namely, Thor Tech, Inc.

The Applicant therefore requests the refusal be withdrawn and the Application be passed to publication.

Evidence in the nature of A document entitled "Assignment of Trademark" assigning all right, title and interest in U.S. Reg.
