Thank you for your message. It appears we are close; however, two items in the identification of goods requires further specification. In particular, “exhaust slip-on” and “custom exhausts for motorcycles” are indefinite because it is not clear what the good is (is it a pipe, is an exhaust for the engine, etc.).  The following is suggested:

 

International Class 007:

Motorcycle exhaust systems comprised of pipes, collectors, mufflers, motorcycle tail exhaust pipes, exhaust side pipes, exhaust slip-on pipes, custom exhausts for motorcycle engines, exhausts for motorcycle engines, motorcycle exhaust pipes; the foregoing does not include flow, temperature and pressure sensors and gauges.

Please let me know if this is acceptable, and I can enter the Examiner’s Amendment.

My client has agreed to amend the identification of goods and services to the language highlighted in yellow below. Based upon our previous emails I believe this amendment should overcome the 2d rejection.

Motorcycle exhaust systems comprised of pipes, collectors, mufflers, motorcycle tail exhaust pipes, exhaust side pipes, exhaust slip-on, custom exhausts for motorcycles, exhausts for motorcycle engines, motorcycle exhaust pipes; the foregoing does not include flow, temperature and pressure sensors and gauges.

Please let me know if you agree that the above amendments and my previous arguments by email to you would overcome the 2d rejection.  If so, please let me know if you can enter an examiner’s amendment reflecting the same.
