TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

This Office action is in response to applicant’s communication filed on January 30, 2017.
It is noted, that the 2(d) refusal and prior pending applications have been withdrawn. See TMEP §§713.02, 714.04
Further, the applicant has requested the identification of services be amended. The request is not accepted for the reasons stated below.
AMENDMENT TO IDENTIFICATION OF SERVICES NOT ACCEPTED
In this case, the application originally identified the services as follows:
Class 36: Banking Services
However, the proposed amendment identifies the following services:
Class 41: Non-downloadable software platform that allows real-time credit underwriting and the provision of credit based thereon
This proposed amendment is beyond the scope of the original identification because providing software platforms is not considered a banking service. Accordingly the original identification of banking services remains operative.
ENTITY INFORMATION REQUIRED – CONTINUED AND MAINTAINED
Applicant has specified that it is a joint venture organized in the State of New York. Applicants who identify as joint ventures must list the names, legal entities and national citizenship or the U.S. state or foreign country of organization or incorporation of all the general partners or joint venturers. 37 C.F.R. §2.32(a)(3)(ii)-(iv); TMEP §§803.03(b), 803.04.

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.
