Applicant submits this Request to Divide with respect to Classes 9 and 41, which should remain in Serial No. 86/585,447 as the parent application. The newly created child application should be limited to Applicant's Class 38 services.
Applicant's Ser. No. 86/585,447 is currently suspended based on a citation to Ser. No. 86/455,652 which covers Classes 35, 38, 42 and 45. Applicant respectfully requests that once the Request to Divide is processed, that the Examiner remove the parent application in Classes 9 and 41 from suspension as there is no overlap between the parties' respective services and therefore no likelihood of confusion.
Since Applicant is not dividing within any of its classes, there should be no additional class fees. The Examiner is urged to contact Applicant's counsel if there are any questions. |
