To the Commissioner for Trademarks:

            Pursuant to Trademark Rule 2.87, Applicant requests that the following goods (all the goods except the Class 32 goods) be divided from the above-referenced application:

Class 27:        bath mats; bath rugs

 

Class 28:        yoga mats; bags specially adapted to carry yoga equipment; yoga straps; yoga blocks; yoga boards; personal exercise mats; fitness equipment, namely, straps used for yoga and other fitness activities and for carrying a yoga mat; stretch bands used for yoga and physical fitness purposes; exercise weights; exercise balls; exercise bars; work-out gloves; exercise balance pods; ball-shaped exercise weights; foam rollers for exercise

 

Class 29:      yogurt

I.         The remaining goods in the application are in Class 32 only. The reason for this division is a blocking citation of a pending application in Class 32, SN 86318073, in the suspension notice dated January 25, 2016. With this division, the blocking citation is inapplicable to the new child application for the above classes. That child application should now be passed to publication.

II.        The goods in Class 32 will remain in the parent application, and that application can remain in suspension.

            Please charge our deposit account No. 230825 the $100 for the fee for the Request to Divide.  If this amount is incorrect or insufficient, please charge any deficiency or overage to our deposit account.

 

The signatory has confirmed that he/she is an attorney who is a member in good standing of the bar of the highest court of a U.S. state, which includes the District of Columbia, Puerto Rico, and other federal territories and possessions; and he/she is currently the applicant's attorney or an associate thereof; and to the best of his/her knowledge, if prior to his/her appointment another U.S. attorney or a Canadian attorney/agent not currently associated with his/her company/firm previously represented the applicant in this matter: (1) the applicant has filed or is concurrently filing a signed revocation of or substitute power of attorney with the USPTO; (2) the USPTO has granted the request of the prior representative to withdraw; (3) the applicant has filed a power of attorney appointing him/her in this matter; or (4) the applicant's appointed U.S. attorney or Canadian attorney/agent has filed a power of attorney appointing him/her as an associate attorney in this matter.
