OFFICE ACTION
TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.
ISSUE/MAILING DATE: 11/11/2016
This Office action is in response to applicant’s communication filed on November 10, 2016.
In a previous Office action dated July 25, 2016, the trademark examining attorney required applicant to amend the identification of goods.
In its response, applicant amended the identification of goods. However, the amended identification of goods still includes indefinite language. Accordingly, the requirement to provide a definite identification of goods is MAINTAINED and now made FINAL.
IDENTIFICATION OF GOODS REQUIREMENT
Applicant’s amended identification of goods is as follows: “Reverse osmosis water purification system and components, namely, reverse osmosis water purification system with heat disinfection comprised primarily of a semipermeable membrane, high pressure pump, and integrated instrumentation for use in medical applications, namely, for use in connection with medical dialysis,” in International Class 10.
In this case, applicant has provided the following goods as the primary components of the system: “semipermeable membrane,” “high pressure pump” and “integrated instrumentation.” The nature of the goods intended by this wording is not clear. Applicant must specify the type of membranes and instrumentation, and the use of the pumps.
Applicant may adopt the following identification in International Class 10, if accurate: “Reverse osmosis water purification system and components, namely, reverse osmosis water purification system with heat disinfection comprised primarily of a semipermeable artificial tympanic membrane, high pressure pump for ____ {specify Class 10 purpose, e.g., delivering measured amounts of solutions into the bloodstream over time}, and integrated instrumentation, namely, ____ {specify the Class 10 type of instrumentation, e.g., dialysis machines, medical instruments for use in dialysis}, for use in medical applications, namely, for use in connection with medical dialysis,”
For assistance with identifying and classifying goods and services in trademark applications, please see the USPTO’s online searchable U.S. Acceptable Identification of Goods and Services Manual. See TMEP §1402.04.
