The application was refused on the grounds that it is descriptive, i.e. the words in the mark describe a feature of the services in the application and/or are laudatory and therefore tout the benefits and/or quality of the services. You may argue against that refusal or you may amend the application to the Supplemental Register and disclaim the word “valet.” You may review the consequences of amending to the Supplemental Register here: http://tmep.gov.uspto.report/RDMS/TMEP/current#/result/TMEP-800d1e2673.html?q=supplemental%20register&ccb=on&ncb=off&icb=off&fcb=off&ver=current&syn=adj&results=compact&sort=relevance&cnt=10&index=2.

Good Afternoon Shaila,

 

You recently reviewed my trademark registration (87567639). Your contact info was on the office action so I was hoping it's okay to contact you, I was wondering what can be done to get the registration approved? I am not familiar with trademark law so anything will help.

 

First Class Valet is the name of my valet parking business and I'm trying to trademark the name because there are businesses in the area popping up with the same name which is now hurting my business.
