Dear Ms. Curry:
I am the examining attorney assigned to your application for “C” with a design element, serial no. 86956410. I am writing to see if we can resolve some of the issues by way of an examiner’s amendment.
First, the color claim requires that generic color claims must be used. The further specification in your color claim is not necessary. My suggestion would be that we amend it to: The colors red, burgundy, and black are claimed as a feature of the mark.
Second, from your color claim, white does not appear to be claimed as a feature of the mark. To clarify this, I suggest that we include in the mark description that white represents background so that the description would read: The mark consists of 3 concentric “C”s tilted slightly upward so the opening is higher than center, in colors blending from red to burgundy to black, with a smaller, solid red circle in the center of the “C”s with white representing background.
