TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $50 per international class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04. However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone without incurring this additional fee.
On August 17, 2016, the trademark examining attorney and Vicki Dowell discussed the issue below. The trademark examining attorney has reviewed applicant’s response filed on July 5, 2016. The following requirement is maintained and now made FINAL. See 37 C.F.R. §2.63(b); TMEP §708.03. Applicant must timely respond to these issues. The six-month deadline for filing a response specified above, or in the alternative, for filing an appeal to the Trademark Trial and Appeal Board, remains in effect. See 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.63(b)(2)-(3); TMEP §§708.03, 714 et seq.
Applicant has agreed to comply with the following stated requirements:
The specimen submitted is unacceptable because it is blurry and the wording in the mark, namely, “BUDDY” is illegible and cannot be read.
Applicant has agreed to submit a clearer image of specimens that are labels and that show the mark as it appears on the drawing page. Applicant has been advised that a declaration will not be necessary if the submission is merely a clearer image of what was previously submitted.
Accordingly, pending receipt of a legible acceptable specimen, the refusal to register the mark because the specimen fails to show the applied-for mark in use in commerce is hereby made FINAL. Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).
RESPONSES TO A FINAL REFUSAL
Applicant must respond within six months of the date of issuance of this final Office action or the application will be abandoned. 15 U.S.C. §1062(b); 37 C.F.R. §2.65(a). Applicant may respond by providing one or both of the following:
(1) A response that fully satisfies all outstanding requirements and/or resolves all outstanding refusals.
(2) An appeal to the Trademark Trial and Appeal Board, with the appeal fee of $100 per class.

In certain rare circumstances, an applicant may respond by filing a petition to the Director pursuant to 37 C.F.R. §2.63(b)(2) to review procedural issues. 37 C.F.R. §2.64(a); TMEP §714.04; see 37 C.F.R. §2.146(b); TBMP §1201.05; TMEP §1704 (explaining petitionable matters). The petition fee is $100. 37 C.F.R. §2.6(a)(15).
