REFUSAL(S)/REQUIREMENT(S) CONTINUED AND MAINTAINED: The following refusal(s)/requirement(s) is/are continued and maintained: the refusal of the mark under Section 2(d) of the Trademark Act resulting from U.S. Registration Nos. 4248999; 4409879; 4413358; and 4585130. The examining attorney has considered the evidence and arguments provided through applicant’s recent response. However, these are not persuasive based upon the similarities of the marks and the services as identified in the cited registrations.
It is noted that applicant has responded to the requirement for information concerning the significance of the proposed mark.
The USPTO will periodically conduct a status check of the application to determine whether suspension remains appropriate, and the trademark examining attorney will issue as needed an inquiry letter to applicant regarding the status of the matter on which suspension is based. TMEP §§716.04, 716.05. Applicant will be notified when suspension is no longer appropriate. See TMEP §716.04.
