No Conflicting Marks Noted

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

Amended Recitation of Services Required in Class 35

 

The wording “Providing shared business facilities, namely, private offices and rooms, communal office space, conference rooms, kitchen, café, receptionist and other support staff, and office equipment and other amenities for business purposes; providing holistic business facilities, namely, providing private and communal spaces for physical and mental health sessions, classes, and appointments all for business purposes” and “providing educational programs, conferences, classes, events, and other networking opportunities for business purposes” in the identification of services must be clarified because it is too broad and could include services in other international classes.  See TMEP §§1402.01, 1402.03.  Applicant may substitute the following wording, if accurate:  providing shared facilities for the use of office equipment and machinery in Class 35; Providing co-working facilities equipped with office equipment in Class 35; Providing temporary kitchen facilities in Class 43; Providing conference rooms in Class 43; Providing business support staff services in Class 35; providing café services in Class 43; providing specialized holistic facilities for fitness instruction in Class 41; providing holistic medical facilities for mental health therapy sessions in Class 44; providing holistic general purpose facilities for holding educational classes in Class 43; providing holistic facilities for business meeting appointments in Class 35; providing educational programs, conferences, classes, events in the field of business management in Class 41; business networking in Class 35.

 

Applicant may adopt the following identification, if accurate:

 

Class 35:         Providing co-working facilities equipped with office equipment; providing business support staff services; providing holistic facilities for business meeting appointments; providing business development services to start-up, small companies, and entrepreneurs; providing online business research and networking services

 

Class 41:         Entertainment and educational services, namely, seminars, conferences, conventions, exhibitions, classes, events, and workshops in the fields of business development, physical fitness, and social networking; providing specialized holistic facilities for fitness instruction; providing educational programs, conferences, classes, events in the field of business [indicate the field or subject matter of the services].

 

Class 43:         Providing temporary kitchen facilities; providing conference rooms; providing café services; providing holistic general purpose facilities for holding educational classes;

 

Class 44:         Providing holistic medical facilities for mental health therapy sessions.

Applicant’s services may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Applicant may clarify or limit the identification by inserting qualifying language or deleting items to result in a more specific identification; however, applicant may not substitute different services or add services not found or encompassed by those in the original application or as acceptably amended.  See TMEP §1402.06(a)-(b).  The scope of the services sets the outer limit for any changes to the identification and is generally determined by the ordinary meaning of the wording in the identification.  TMEP §§1402.06(b), 1402.07(a)-(b).  Any acceptable changes to the services will further limit scope, and once services are deleted, they are not permitted to be reinserted.  TMEP §1402.07(e).

 

Advisory – Multiple Class Application Requirements

 

The application identifies services in more than one international class; therefore, applicant must satisfy all the requirements below for each international class based on Trademark Act Section 1(b):

 

(1)       List the services by their international class number in consecutive numerical order, starting with the lowest numbered class.

 

(2)       Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule at http://www.gov.uspto.report/trademarks/tm_fee_info.jsp).  The application identifies services that are classified in at least three classes; however, applicant submitted fees sufficient for only two classes.  Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

The fees for adding classes to a regular TEAS application are $325 per class when the fee is paid using the Trademark Electronic Application System (TEAS) and $375 per class when the fee is paid in a paper submission.  See 37 C.F.R. §2.6(a)(1)(i)-(ii); TMEP §§810, 1403.02(c).

 

Closing Information

 

If applicant does not respond to this Office action within the six-month period for response, the following services in International Class 35 will be deleted from the application:  Providing shared business facilities, namely, private offices and rooms, communal office space, conference rooms, kitchen, café, receptionist and other support staff, and office equipment and other amenities for business purposes; providing holistic business facilities, namely, providing private and communal spaces for physical and mental health sessions, classes, and appointments all for business purposes; providing educational programs, conferences, classes, events, and other networking opportunities for business purposes. 

 

The application will then proceed with the following services in International Classes 35 and 41 only:  “providing business development services to start-up, small companies, and entrepreneurs; providing online business research and networking services;” in Class 35; “Entertainment and educational services, namely, seminars, conferences, conventions, exhibitions, classes, events, and workshops in the fields of business development, physical fitness, and social networking” in Class 41.  See 37 C.F.R. §2.65(a)-(a)(1); TMEP §718.02(a).

 

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $50 per international class of services.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone without incurring this additional fee.
