This is a corrective action. After further review, applicant's mark was withdrawn from publication because a portion of the wording in the identification of goods and services is indefinite and overbroad and because the wording “providing . . . imagery” as used is unclear. The undersigned apologizes for any inconvenience that this may cause the applicant.  

 

SUMMARY OF ISSUES:

IDENTIFICATION OF GOODS AND SERVICES REQUIREMENT

 

The particular wording (1) “Providing on-line forums in the nature of webinars and on-line discussions, which allow users to exchange information and research, provide and receive feedback, and engage in peer review, regarding research in the fields of …;” and (2) providing on-line forums in the nature of webinars and on-line discussions, for on-line collaboration in the fields of technology, use of imagery, geospatial intelligence and analysis, manned and unmanned aerial vehicles and related technology in the nature of computer vision technology and other remote sensing technologies, …” is indefinite and overly broad and must be clarified because “Providing on-line forums in the nature of webinars” could include services in Classes 38, 41 and possibly 42. 

 

While “on-line forums” are in Class 38 when transmitting messages, ambiguity arises as to the precise nature of the services with respect to “webinars” which are generally education services. 

 

Additionally, the identification of services “which allow users to” is possibly identifying a Class 42 technology service.  Please clarify and, if necessary, re-classify the services accordingly.     

 

Please see the following ID Manual entries for guidance: Providing an on-line forum for {indicate field or subject of forum} is a Class 38 service. Education services, namely, providing non-downloadable webinars in the field of {indicate specific field, e.g., pet care, math, tax preparation} is a Class 41 service.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. 

 

Also, in Class 36, the services identified as “providing an interactive website featuring information, imagery, and analysis relating to electrical utilities infrastructure…”, “providing an interactive website featuring information, imagery, and analysis relating to analysis of infrastructure…”, and “providing information, imagery, and analysis relating to electrical utilities infrastructure…” are indefinite and misclassified.

 

The service of providing information is classified according to subject matter. See TMEP §1402.11(b). Because this information is about electric utilities infrastructure, these services may be in Class 37 if concerning the construction of infrastructure or Class 42 if it is about the design or planning of infrastructure.

 

Also, the wording "providing … imagery" is unclear, and “imagery” should be changed to “images” if accurate.

 

In addition, the wording "analysis" must be further specified. Financial analysis services are in Class 36, but industrial design analysis is classified in Class 42.  Please clarify the nature of these services and reclassify them as necessary.

 

Applicant must specify the common commercial or generic name for the goods.  If there is no common commercial or generic name, applicant must describe the product and intended consumer as well as its main purpose and intended uses.
