TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $50 per international class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04. However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone without incurring this additional fee.
The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
Search Results
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
Section 2(e)(4) Refusal – Primarily Merely a Surname
The following five factors are used to determine whether a mark is primarily merelya surname:
(1) Whether the surname is rare;
(2) Whether anyone connected with applicant uses the term as a surname;
(3) Whether the term has any recognized meaning other than as a surname;
(4) Whether the term has the structure and pronunciation of a surname; and
(5) Whether the term is sufficiently stylized to remove its primary significance from that of a surname.
See In re Binion, 93 USPQ2d 1531, 1537 (TTAB 2009); In re Benthin Mgmt. GmbH, 37 USPQ2d 1332, 1333-34 (TTAB 1995); TMEP §1211.01.
The following evidence is most relevant in determining the surname significance of the applied-for mark.
With respect to the first factor, a LexisNexis public records search returned 418 listings for individuals with the surname of “CORLEONE”, the first 100 of which are attached to this office action. Thus, the surname “CORLEONE” is not an uncommon surname.
Furthermore, although the mark contains the additional wording “FORGED,” combining a surname with the generic name for the goods does not overcome a mark’s surname significance. See Mitchell Miller, P.C. v. Miller, 105 USPQ2d 1615, 1622 (TTAB 2013) (holding MILLER LAW GROUP primarily merely a surname for legal services, noting that LAW GROUP is a generic designation for a law firm); In re Hamilton Pharms. Ltd., 27 USPQ2d 1939, 1944 (TTAB 1993) (holding HAMILTON PHARMACEUTICALS primarily merely a surname for pharmaceutical products); In re Cazes, 21 USPQ2d 1796, 1797 (TTAB 1991) (holding BRASSERIE LIPP primarily merely a surname for restaurant services); TMEP §1211.01(b)(vi).
In the instant case, the attached evidence from
demonstrates that the word “FORGED” is a generic term to describe a type of wheel. Thus, the mere addition of the term “FORGED” to the surname “CORLEONE” does not obviate its surname significance.
As to the second factor, the record indicates that no one connected with the applicant uses the word “CORLEONE” as a surname. However, this factor is of slight significance because, as demonstrated by the evidence of record, “CORLEONE” is primarily merely a surname.
With respect to the third factor, the attached evidence from the American Heritage Dictionary returns no definitions for the word “CORLEONE.” Moreover, although “CORLEONE” is also the name of a small town in in the Province of Palermo in Sicily, Italy, “CORLEONE” is not a well-known place and the geographic significance of “CORLEONE” does not dissipate is primary significance as a surname. In re Hamilton Pharm. Ltd., 27 USPQ2d 1939 (TTAB 1993); see also In re Gregory, 70 USPQ2d 1792 (TTAB 2004).
Regarding the fourth factor, given the notoriety “CORLEONE”, as evidenced by the attached evidence from http://en.wikipedia.org/wiki/Corleone_family, which discusses the CORLEONE family made popular in the book The Godfather, as well as the film series by the same name, the word “CORLEONE” is recognized as having the structure and pronunciation of a surname. http://en.wikipedia.org/wiki/The_Godfather_(film_series). Due to the substantial evidence demonstrating the primary significance of “CORLEONE” as a surname, the fifth factor is not relevant for the purposes of surname significance analysis in the instant application because the mark appears in standard characters and is not sufficiently stylized to obviate the surname significance.
Although applicant’s mark has been refused registration, applicant may respond to the refusal(s) by submitting evidence and arguments in support of registration.
